At the request made by the mother of a child sexual victim, the Judge at the High Court in Sri Lanka (Case No 39/2004), made a recommendation to the Attorney General to withdraw the indictment.

After considering all the facts involved and in view of the sheer severity of the damage that could cause to the victim in this particular case, the AG agreed to withdraw the charges. Unfortunately the news papers published the details of the case including false information violating the child's right to privacy and confidentiality, totally destroying the intentions of the courts and causing immense damage to the victim and her family.

This secondary victimization has severely damaged the victim without giving her the opportunity to rebuild her life.

We the undersigned stand for Children’s rights and;
Strongly condemn the practices of the media violating the confidentiality and publishing articles or broadcasting news which identify the victims of child sexual abuse in Sri Lanka.

We call on the above authorities to ban publishing the name of the victims, his/her parents or the immediate family members.

We insist that a rapid action task force to be implemented immediately to take strong action if the media violates children’s rights and publish/broadcast any information that can identify a child sexual victim.
We insist and demand the above authorities to take rigorous action possible against the press and order the newspapers that published articles with information leading to identifying the victim of the Kandy High Court Case No 39/2004, to rectify the damage caused to the victim and her family with the highest compensation.

We further urge International human rights bodies and other authorities to join in this effort to persuade the government of Sri Lanka to acknowledge and honor the call of this petition.
