APPEAL FOR INTERVENTION IN KENYA

As Kenyans living in the United States, we wish to thank your government for swift condemnation of the flawed electoral results tallying process, as was pointed out by poll observers, and the subsequent announcement of the same results by the electoral commission in Kenya, and seek the US government necessary intervention to avert the crisis that Kenya has been plunged into.

The malpractice which was a blatant abuse of the essential tenets of the democratic electoral process has compelled Kenyans to denounce the results, which saw the hurried and unprocedural swearing in of Mwai Kibaki, through street protests. The government’s response by unleashing its security apparatus on Kenyans has led to the unrest that has culminated into a grave humanitarian situation that has seen the loss of lives, property, restricted movement, muzzled press and media, displaced families, lack of food and water supplies. This amounts to abuse of human rights recognized in the UN Human Rights Charter and Kenyans’ legal rights enshrined in the constitution of the land. It has also highly polarized Kenya’s multi-ethnic communities against Mwai Kibaki’s Kikuyu ethnic group; this if not stemmed fast enough, could degenerate into massive losses of lives and property.

The Electoral Commission of Kenya (ECK) declared Mwai Kibaki the winner amid calls for a re-tally of the vote results from the Chief Observer of the EU Election Observation Mission (EU EOM), Mr. Alexander Graf Lambsdorff, Member of the European Parliament; Mr. Kipkemei arap Kirui, an officer with ECK; and members of the diplomatic missions in Kenya specifically the US Consulate, the British High Commission and the Canadian Embassy. This cast deep credibility concerns of the whole process.

The explosive situation is a threat to both national and international peace and security, and this is a serious breach of international law and norms as enshrined in the United Nations Security Council articles on international peace and security.

It is on this basis that we are seeking your government’s intervention to help Kenyan’s regain their democratic choice and rights as they have been denied by the Kibaki administration. This can only be achieved through the rightfully elected leadership.
