In the State of Wisconsin, it is illegal to sell baked goods from your home kitchen. Failure to obey can result in up to $1,000 in fines or six months in jail.
The proposed 'Cookie Bill' would allow home bakers to promote and sell non-hazardous baked goods; such as, cookies, breads, cakes, etc., from their home without a processing license or commercial kitchen, under $7,500 a year.
One of the biggest concerns with the passing of this bill, is food safety. Although, bake sales can be held up to 12 times a year for non-profit organizations, churches and schools; without any special licensing or kitchen requirements. The 'Pickle Bill' has already been passed through Wisconsin, allowing the sale of jams, salsas, applesauce, pickles, etc. from an unlicensed/non-commercial kitchen, with sales under $5,000 a year.
Businesses will still be registered with the State of Wisconsin and will need to complete a Food & Safety course, all food products that are distributed must be labeled "These canned/baked goods are homemade and are not subject to State inspection." Therefore, consumers are purchasing at their own risk. Allowing this law to pass, would allow entrepreneurs to get a jump start on their businesses and create jobs for Wisconsin citizens.
Wisconsin and New Jersey are the only two States that do not allow the sale of home-baked goods to the public. This January, the bill received a unanimous vote through the Senate once again; first time, being in 2014 SB417, but is again being held at going to the Assembly for a vote.
We have until early April 2016, for this bill to be placed on the calendar for a vote by the Assembly.
We, the undersigned, call on the Wisconsin State Legislature to allow the sale of non-hazardous, home baked goods in the State of Wisconsin under law SB330.
