The House of Representatives, but not the Senate, can be dissolved at any time by the Governor-General.
The House expires 3 years after its first meeting if not earlier dissolved. The Senate can be dissolved by the Governor-General only when the double dissolution provisions are invoked, in which case the House of Representatives is also dissolved at the same time.
There exists a convention that the Governor-General only orders a dissolution on the advice of the Prime Minister.
This convention was broken in 1975, resulting in a very serious constitutional crisis in Australia, when the Governor General controversially exercised his reserve powers and dismissed the Federal majority government of Labor Prime Minister Gough Whitlam.
Addressed to Her Excellency Ms Quentin Bryce AC Governor-General of the Commonwealth of Australia,
We the people of the Commonwealth of Australia have lost all confidence in the current Australian Federal Parliament & Prime Minister Julia Gillard.
The people have no trust in the probity and integrity of the current Prime Minister & members of parliament, and we believe that they are too motivated by self-interest to seek their own dissolution..
We further believe that if the situation is permitted to continue, irreparable harm will be done to the institutions of democracy in Australia.
We therefore implore you to exercise the constitutional initiative to dissolve this current Gillard Government & Parliament, that a new one may be elected.
We reserve the right to gazette further amendments to this petition based on the results of current or future activities of the Gillard Government.
