1. The variance is not contrary to the public interest as there are already existing precedents where the distance of the structures to the street curb exceed the distance of 15'-4" for the proposed 2-car garage.

2. Due to special conditions, a literal enforcement of the ordinance would result in unnecessary hardship.

3. By granting the variance, the spirit of the ordinance will be observed and substantial justice will be done as the proposed structure will not be in conflict with the public health, safety, morals, or general welfare nor will it be in conflict with places and areas of historical, cultural, or architectural importance and significance.

4. Such variance will not authorize the operation of a use other than those uses specifically authorized for the district in which the subject property is located.The variance will only be for the extension of a residential 2-car garage for the security of personal property.

5. The plight of the owner of the property is due to unique circumstances existing on the property, and the unique circumstances were not created by the owner of the property and are not merely financial, and are not due to or the result of general conditions in the district in which the property is located. The lot is only 75ft wide.

The existing house takes up most of the frontage; there is not room for a garage addition on either side of the existing residential structure. Secondly, the existing sanitary sewer utility piping beneath the house is broken in several places. Tunneling beneath the house through the hard expansive clay for repairs would be infeasible; therefore abandoning existing SS line and relocating the kitchen to a more suitable functional location and to access new sewer line.

By signing this petition the neighbors of the Knibbe Ave District agree that such variance will not substantially injure the appropriate use of adjacent conforming property or alter the essential character of the district in which the property is located.
