W.C.A Partners has applied for a NEW Special Use Permit and rezoning to build a dense development on Martin Luther King Jr. Blvd just south of Weaver Dairy Road. They did this by RECOMBINING the lots and CIRCUMVENTING the NEIGHBORHOOD'S RIGHT TO USE A PROTEST PETITION - a NC State right since 1923.

Some of the problems with this application include:

SETS THE PRECEDENT OF MAKING VALID PROTEST PETITIONS UNUSABLE

BOOKER CREEK HEADWATERS - CURRENTLY IMPAIRED AND WILL BE FURTHER IMPAIRED BY DEVELOPMENT

LOSS OF DOZENS OF UP TO 200 YEAR OLD TREES -
HEALTHY TREES WITH GIRTHS UP TO 49" WILL NOT SURVIVE

MARKET SATURATION FOR ALL PROPOSED USES:
APARTMENTS, TOWNHOMES, RETAIL, OFFICE, AND BANKS ARE ALL AVAILABLE SURROUNDING THE SITE

SCHOOLS ARE OVER CAPACITY

NO AFFORDABLE HOUSING-THIS IS A LUXURY HIGH-END APARTMENT COMPLEX

HOUSING PROVIDES NO ECONOMIC BENEFIT FOR THE TOWN

MANY DETAILS, INCLUDING APPEARANCE, WILL NOT BE SETTLED UNTIL AFTER THE SPECIAL USE PERMIT IS ISSUED

NO WHERE ELSE IN CHAPEL HILL DOES THIS LEVEL OF DENSITY ADJOIN A RESIDENTIAL NEIGHBORHOOD...YET

We the undersigned request that the Mayor and Town Council of Chapel Hill deny WCA Partner’s applications for a Special Use Permit and rezoning because Charterwood does not:

 ACHIEVE THE PURPOSES OF THE COMPREHENSIVE PLAN
 MAINTAIN THE HEALTH, SAFETY, AND GENERAL WELFARE
 MAINTAIN OR ENHANCE THE VALUE OF CONTIGUOUS PROPERTY

Minimum adjustments to this proposal must include:
 REDUCE SURFACE PARKING
 REDUCE RESIDENTIAL COMPONENT
 INSURE ADEQUATE NEIGHBORHOOD PROTECTION
 RESPECT OF ENVIRONMENTAL CONSTRAINTS OF SITE
