We, the Tree Committee of the Nutley Community Preservation Partnership, feel the current tree ordinance is not effective. Private property owners and developers are able to clear cut lots and properties, resulting in the destruction of Nutley’s pre-existing tree canopies. Replacement trees of equal value are not required.

As cited in the Nutley code, Article I, ‘to preserve the public health, safety or general welfare of the community,’ we need to strengthen our tree ordinances.

1- Our petition requests a permit requirement for removal of any tree. The current ordinance excludes from permit requirements any tree within the “building envelope”. (The ordinance defines the building envelope as any tree within 15 feet of the property line).

2- Our petition requests the Tree Bank waiver to be removed, so that the fifty dollar ($50.00) fee is required for any tree. The existing tree ordinance waves the fee if one promises to replace the tree. (The objective of the tree bank is to have continual funds for future plantings.)

3- Our petition requests the definition of “significant tree” to be expanded to include the Drip Line. (The circle that could be drawn on the soil around a tree directly under the tips of its outermost branches is called a drip line. Rain water tends to drip from the tree at this point. The existing ordinance defines ‘significant tree’ as having a diameter greater than 18’ measured at a point 4 feet above the ground.)
