Just recently, in the month of September or August of 2007, a Federal Court has granted the Navy the right to administer dangerous frequencies of sonar that are and have been known to have adverse effects on many marine creatures, namely whales.

To the Honorable Secretary of State of California

We the above signed registered, qualified voters of California, residents of the above mentioned County and/or City hereby propose amendments to the California Penal Code and petition the Secretary of the State to submit the same to the voters of California for their adoption or rejection at the next succeeding general election or at any special statewide election held prior to that general election or otherwise provided by law.

The proposed statutory amendments read as follows;

In the ruling of the Navy vs. California Coastal Commission, let the former ruling of allowing the Navy the use of under water sonar emitting techniques during their routine battle-training exercises to be hereby revoked on the grounds of reckless endangerment of living species known to be found natively in the same location as that of which where the sonar training would take place.

Not only is it recognized by the state of California, but also by all citizens of this nation who choose to vote in regards to preserving a marine species of life that is currently found to be listed as being endangered. To further endanger such a species already recognized as a species that is in need of special attention to be looked over should the entire species cease to exist, is a gross violation of Federal laws as well as the rights to each and every citizen who is in strong objection of such displays of disregard for life especially for the sole purposes to procure more death.

No sonar is to be used in and around the areas frequented by those creatures known to suffer adversely due to the effects of these such technologies. This amendment refers specifically, but not solely, to whales.
