Iran has the second highest rate of executions in the world. The Iranian authorities have carried out enforced disappearances, used torture and illtreatment in a widespread and systematic manner. Arbitrary deprivation of life remains a
common practice, through the imposition of the death penalty in a manner violating international law. The widespread use of the death penalty, in particular for offences that do
not constitute “most serious crimes” under international law, has been decried by the HRC
Secretary-General and NGOs. Children have also been subjected to the death penalty, in
violation of the international human rights law instruments ratified by the Islamic Republic of
Iran which prohibit the execution of persons younger than 18 years old at the time of the
offence. More broadly, justice is not done in accordance with international law as death
penalties are often imposed based on confessions obtained through torture or inhumane
treatments, or after violations of the right to a fair trial. As the following section explains,
minorities, women and the LGBTQ+ community particularly suffer from the poor justice
system and absence of rule of law. The Islamic Republic of Iran has ratified two major human rights treaties: the
International Covenant on Civil and Political Rights (ICCPR, in 1975), and the International
Convention on the Rights of the Child (CRC, in 1994) providing, among other things, the
right to a fair trial, the prohibition of the juvenile death penalty, and that the death penalty may
only be imposed for crimes deemed to be "the most serious". Iran has not made any
reservations to the ICCPR, and the death penalty has been used for crimes that are not considered as the "most serious". Concerning the CRC, Iran made a reservation upon
ratification of the CRC: “If the text of the Convention is or becomes incompatible with the
domestic laws and Islamic standards at any time or in any case, the Government of the Islamic
