Fresno rental property owners have turned to social media in an attempt to reach out to other property owners within the city of Fresno that rent out either a single-family home, condo, or apartment. As you have probably heard, the city of Fresno has passed an ordinance in which all rental housing within the city of Fresno is to be registered with the city. From that list, the city will begin inspecting all rental units for what they are calling "health and safety issues". These inspections will cost "up to $100.00" for each unit inspected. Apartment units and multi-family units will be inspected based on a percentage of the units. If your units pass inspection, you will still be required to file a safety report annually with the city of Fresno.

Mayor Brand has estimated there are approximately 85,000 to 90,000 rental units within the city of Fresno. If the charge is $100 per unit for the inspections, it would result in $8.5-$9 million going from property owners into the city’s coffers. I believe if we stick together, we can challenge the constitutionality of this ordinance. The Fourth Amendment to the United States Constitution says there will not be unlawful searches of your property. The city attorney has said if we do not allow the inspectors to inspect our properties, they will get an inspection warrant. The Constitution also says you cannot get a warrant without reasonable cause for the search.

Landlords in California, and in other States, are challenging similar ordinances and ruling them unconstitutional.

There is strength in numbers, and if we all get together, I believe we could protect our rights as property owners. We, Fresno City rental property owners, call on the Fresno City Council of The City of Fresno in the State of California, to eliminate the newly passed Rental Housing Improvement Act (the "Ordinance") which includes unreasonable searches and fines which are unconstitutional under the Fourth and Fifth Amendments of the United States Constitution.
