Cape Cod Aggregates has recently purchased Freetown Sand and Gravel and has submitted an application to the Berkley Soil Conservation Board to operate a Quarry to 120' below sea level (up to 250' below existing grade) in Berkley. This directly affects the health, safety and quality of life for all residents of the town.

This petition is to have this quarry stopped by any means necessary to ensure the residents of Berkley are not harmed in any way by this proposed project.

We, the undersigned residents of Berkley, call on the Soil Conservation Board to safeguard the rural character of our town and the welfare of its residents by rejecting the application of Cape Cod Aggregates for an earth alteration permit that will allow the establishment of a quarry.

This operation on residentially zoned land will cause significant harm to neighbors through the creation of excessive noise and dust, potential damage to our homes through the use of explosives, potential damage to our wells and substantial loss of our homes’ property values. Article 12, Section 9 of Berkley’s Bylaws specifically grants the Soil Conservation Board the power to deny earth alternation permits that will create “conditions dangerous to premises and residents in the neighborhood” or that will create “noise, vibration, dust, heat, smoke, odor, glare or other nuisances or serious hazards so as to adversely affect the immediate neighborhood.” Because both conditions for denial are present, we urge the Soil Conservation Board to reject Cape Cod Aggregates’ application.
