People released early from Prison are currently returning due to the "firearms" supervision condition.
It states that Any Convicted Felon on Parole can not be around or possess any firearms. Object(s) such as BB guns, squirt guns, air guns ect. have been and are currently costing millions of taxes payers dollars because OUR government is considering these items "firearms". Over crowding is a problem we face today in the prison system. Charles E. Egler Reception and Guidance facility is so full, men bunk two people per an 8X12 cell.
Under Michigan Penal Code 750.222 it states " "Firearm” means a weapon from which a dangerous projectile may be propelled by an explosive, or by gas or air. Firearm does not include a smooth bore rifle or handgun designed and manufactured exclusively for propelling by a spring, or by gas or air, BB's not exceeding .177 caliber."
"The Supreme Court agreed today to decide whether states may nullify the restrictions imposed by Federal law on a convicted felon's right to own a gun. " Supreme Court Roundup Justices To Rule on Felon's Right to Own Gun written by Linda Greenhouse, published November 16, 1993.
Parolees should not be associated or in possession of any "firearm" that is regulated by law(i.e.Rifle, Shot gun, Semi-Automatic) and correlates with "firearm" as defined in the above mentioned act. "Pseudo Firearms" do not fall under the legal defination of a "Firearm" and therefore men and women who were sentenced because of a "pseudo firearm" should be released immediately.
We, the People of the State of Michigan, call on our government to change the conditions of Parole regarding "Psuedo Firearms".
Parolees should not be incarcerated for "firearms/weapons" that can be sold without permits or registration. However, Parolees should not be around.possess, or associate with "Real" firearms(by definition) that require permits to obtain and are already monitored by the government.
Any man or woman serving a sentence due to the violation of parole because of a psuedo firearm should be released immediately and returned to his/her families.
