City of Milpitas bought 1.68 acre land next to Milpitas City Library with intention to build a park several years ago. Despite Park and recreation commission's positive recommendation and architecture proposal, City never acted and finished the task.

City public works department is treating this land as landfill for the soil rejected by city contractor because of toxic contamination and other chemicals found in the lab test. This land is also being used for street resurfacing project.

These conditions are not only unsafe for hundreds of kids visiting library each day, it poses serious risks to the health of seniors living nearby.

Shabby aesthetics, smell and noise are among several problems experienced by residents living nearby.

It is believed that City of Milpitas is in violation of following ordinances/codes

1. Municipal Neighborhood Beautification Ordinance
2. California Health and Safety Code

We, the undersigned, call on City of Milpitas to hold themselves to ordinance and code it enforces on its citizens and businesses.

We, further, demand city to fund study of this ignored piece of land, its usage and number of violations it has had so far. We, further, demand to take quick action to become and stay compliant.

Such an action would restore neighborhood's confidence in City's ability to maintain and restore land usage and promote public health and safety.
