Basis of our Petition;

(a) A determination as to whether or not the MPs abused power and exceeded their mandate in the unconvincing manner Dr Monica Juma's second vetting was handled;
(b) Whether or not the MPs were conducting an appraisal on her performance since she was successfully vetted as Principal Secretary by the same National Assembly Committee of Parliament;
(c) Whether or not there are defined parameters for vetting of public nominees and whether the National Assembly is at liberty to fish for any other reasons on a candidate cleared by the competent body on ethics and anti-corruption;
(d) Need for judicial review on the limitations of oversight by MPs who appear to set a higher moral ground than they were subjected to by the Independent and Electoral Boundaries Commission.
(e) Being the Committee that initially vetted her and having oversighted her as the PS for Interior, the Hon. Asman Kamama led Committee should have not been the very Committee to re-vet her considering that there could have been obvious conflict of interest (either favour her or rally against her and deny her the benefit of natural justice).

In the circumstances, the Speaker, being neutral party, ought to have chaired this Vetting Committee for Amb Dr Juma and or delegated to another Chairperson but under the Committee on Appointments;

On this basis Your Excellency, we appeal as follows;

(a) THAT you agree with us that the National Assembly over-stepped its mandate, abused its powers and that the decision thereof must be rejected in toto.
(b) THAT you agree with us that double vetting within two years for the same candidate was not necessary and indeed a near formality of sorts;
(c) THAT you either consider re-submitting the name to the National Assembly for concurrence (to the Committee on Appointments and not Security Committee) and or you proceed and appoint Amb. Dr. Monica Juma on the basis of her first vetting and which formal communication you have from the National Assembly;
(d) THAT you direct your Attorney General to immediately put in place a Taskforce jointly with the Commission on the Implementation of the Constitution to address the apparent gaps and propose measures to address the same on the vetting laws;
(e) THAT on the basis of the powers bequeathed to you under Article 135, you concur that we, and other like-minded Kenyans, have legitimacy in exercising our direct sovereign power directly on the matter of vetting of Amb. Dr. Juma.

I stand with the Secretary to the Cabinet designate Amb. Dr. Monica Juma's fair vetting because I honour and respect the Constitution of Kenya as well as rule of law.

I shall not keep quiet, look the other way or be a bystander when the Constitution of Kenya is being violated. I demand natural justice for Amb. Dr. Monica Juma and any other future nominee(s) vetted by the National Assembly.
