Statistically 8% to 12% of all state prisoners are actually innocent. Many people are arrested solely based on accusation.
The law states that we are innocent until proven guilty, however it is legal for a probation officer to place a hold on your bond without knowing whether or not you are guilty.
Many people have to sit in jail until their court date. Meanwhile they have family who are struggling without them. They lose their Jobs and their sense of security. It should be unlawful for any person to be held in jail without a fair trial and without substantial evidence.
It goes against our civil rights to imprison anyone without substantial evidence and a fair trial.
A probation officer should not be allowed to place a hold on anyone's bond before they are proven guilty because it violates the Writ of Habeas Corpus and also the right to due process which is recorded in the fifth and fourteenth amendment in the United States Constitution.
