I was injured at work while restraining a patient in a Psychiatric Ward. This happened on 05.12.2012. My right shoulder was broken. I needed two surgeries to fix it. Then my left shoulder became weak. It is still to be fixed.
After the operation I developed AF and had to be transferred to the RDH for treatment. I have applied for Worker's Compensation but my claim has not settled. La Trobe Financial has foreclosed on my house. I have told them that my claim is at the mediation stage. They have chosen not to wait. I did not have any other source of income for 18 months. So, I fell back on my loans.
La Trobe Financial Services knew that I was on Worker's Compensation when I applied for the loan. I needed the money for my treatments as Worker's Compensation did not pay for my psychiatric and cardiac treatments. So, I was under considerable duress when I signed the loan Agreement. I have proof that I notified La Trobe Financial that I was Worker's Compensation when I signed for the loan.
Last but not least, I now know that I can void the contract because I was suffering from mental health problems when I signed the loan. I was on pain and thought altering medications at that time.
Dear La Trobe,
Nurse Gill was injured at work on 05.12.2012. When you gave him the loan you knew he was on Worker's Comp. You proceeded to give him the loan at 6%. You know he would NOT be able to make the payments. So, why did you give him the loan? You took advantage of his physical and mental health problems. This is socially unjust.
Please end this unfair practice. Let him return to his house. He will pay you from the proceeds, if any, from the settlement. Also, reduce the interest rate to a realistic 4%. This is what everybody pays. Be human, Be fair now. Apply principles of Social Justice without delay. End the suffering of Nurse Gill.
