The Hawaiian Islands Humpback Whale National Marine Sanctuary/NOAA is proposing a Draft Environmental Impact Survey to Expand areas from Hawaii Island throughtout the chain to Ni'ihau and further. This proposal by NOAA will jepordize all our public rights and rights protected under the Hawaii State Constitution Article 12 section 7 to all areas within the demarked Sanctuary boundaries under Federal Jurisdiction.

Our Hawaii oceans have served and been heavily utilized by the public for an array of relaxation and subsistence purposes for many generations and by allowing this proposal it will jepordize the rights of every person.

The State of Hawaii needs to take a strong stance against further development of policies and rules under Federal Laws which have no legal basis within the State of Hawaii's borders.

We, the public, residents, & visitors, young and old, present and future strongly oppose the expansion of the Hawaii Island Humpback Whale National Marine Sactuary and urge the Governor of the State of Hawaii, Department of Land and Natural Resources, all State agencies and legislators to deny the expansion of the sanctuary because expansion jepodizes our people's rights of subsistence and cultural and traditional uses protected under the Hawaii State Constitution.
