Corporations have been wrongfully declaring their workers as "employees" under the IRS Code despite not meeting the definition in the Code.

This letter will be sent or hand delivered to numerous corporations in order to return every dime that has been stolen through coercion and deceit.

We need to move in unison to right this wrong. The rich men north of Richmond have stolen enough of our money already.

To whom it may concern,

It has come to my attention that your corporation has been incorrectly withholding from your workers' paychecks. By what authority (Quo warranto 1) are you engaging in this act?

For many years I've been trying to make sense of the Internal Revenue Code. Then recently someone mentioned how corporations are being deceived by the IRS to manage their system. For free of course.

As a simple carpenter and part-time state representative I will never claim to be a ‘legal beagle’ so please help me if I am mistaken but the definition of "employer" in the Code is confusing me. If you fall under a different definition then let me know but this seemed like the logical choice considering the chapter’s purview.

Subchapter A — Withholding From Wages (Sections 3401 to 3406)

I.R.C. § 3401(d) Employer — For purposes of this chapter, the term “employer” means the person for whom an individual performs or performed any service, of whatever nature, as the employee of such person, except that—

Makes sense when read alone but look at employee:

I.R.C. § 3401(c) Employee — For purposes of this chapter, the term “employee” includes an officer, employee, or elected official of the United States, a State, or any political subdivision thereof, or the District of Columbia, or any agency or instrumentality of any one or more of the foregoing. The term “employee” also includes an officer of a corporation.

Would I be correct in concluding that:

1.) Your workers are not "§ 3401(c) Employees" and

2.) You are not a "§ 3401(d) Employer."

This letter is sent to:

1.) Notice you in regards to these harms and,

2.) Demand the immediate termination of all improper withholding schemes from the pay-checks of workers at this corporation.

In times such as these when most people have lost faith in the "Rich Men North of Richmond" we need to make sure working people keep every dime of their pay-checks.

God created man, man created government and government created corporations. Let us never forget that.

If you have any questions or concerns please reach out to me.

1.) “Quo warranto is Latin for "by what warrant” (or authority). A writ of quo warranto is a common law remedy which is used to challenge a person's right to hold a public or corporate office. A state may also use a quo warranto action to revoke a corporation's charter. When bringing a petition for writ of quo warranto, individual members of the public have standing as citizens and taxpayers.”
