CAYLEE'S LAW THE GLOBAL PETITION

In Memory of Caylee Marie Anthony
August 9, 2005- June 16, 2008

This Petition empowers people world-wide for positive change by establishing laws to further protect children's rights. This petition recognizes "Create Caylee's Law", a Petition which now has over one quarter of million signatures in the United States. We need to make changes on a worldwide basis for the protection of children.

Remembering and in dedication to Caylee Marie Anthony and all the other children who left this earth too soon. On June 16th, 2008 Caylee went missing and her decomposed tiny body was found December 11th, 2008 minutes from her home. These children need our voice to speak on their behalf.

The recent trial of Casey Anthony in the State of Florida USA made it clear and brought to light that laws need to be put into place addressing the issue of the reporting of a child missing or reporting the death of a child.

In 2008 Caylee Marie Anthony was missing for 31 days. Information of Caylee's whereabouts remained unknown until a few months later when Caylee was discovered. Her tiny decomposed body discarded amongst the trash in a swamp only minutes from her mother Casey Anthony's and grandparents Cindy and George Anthony's home. Casey Anthony was charged with Caylee's murder and on July 5th, 2011 was found 'Not Guilty'.

Because of the length of time that had passed, Caylee's remains had become so badly decomposed that all physical evidence such as DNA was lost. It became clear that this would be what is termed a 'dry bone' case. The Prosecution's burden of proof had to be based on circumstantial evidence. A very difficult burden. It is therefore, essential to have laws in place so this does not happen again. We would like to propose that it is a crime, under the law, not to report a missing child or failure to report an accidental, questionable death or death of a child.

Parents, guardians, and caregivers of a child under the age of majority should be required to report a child who is missing under law or be charged accordingly for failure to report to the proper authorities.

This proposed law is in dedication to the memory of Caylee Marie Anthony. Also remembering all the other children who's voices have gone unheard.

Re: Creating Caylee's Law

July 5, 2011, at 1:15 pm CST Casey Anthony was found 'not guilty' of first degree murder in the death of her daughter Caylee Maire Anthony. Ms. Anthony will be released July 13th, 2011.

June 16th 2008 Caylee Marie Anthony went missing. Caylee Marie Anthony's tiny decomposed body was found December 11th, 2008 discovered only minutes from the Anthony's home in Florida USA. It was 31 days before Caylee Marie Anthony was reported to be missing.

I'm writing to propose that a new law be put into effect which makes it a felony when a parent, grandparent, relative, legal guardian, friend or caretaker does not notify law enforcement or the proper authorities within one hour time from the discovery of the death of the child. Regardless, whether the death of the child is accidental or otherwise.

Also, I am requesting at this time for consideration in respect to Caylee's Law that it be a felony for a parent, grandparent, relative, friend, legal guardian, or caretaker that does not notify or report to law enforcement or proper authorities of the disappearance of a child. Notification and reporting must be within a 24 hour period from the known time of the 'child' missing. This is essential in order to have the proper steps taken in order to expedite and begin searching for the child. The first 48 hours are crucial in investigations of this type.

Enforcement of Caylee's Law there would be no cases being heard before the court like the Casey Anthony's trial. More important, there would be no more innocent and voiceless children who will have had no justice within the court system.

DEFINITIONS:

Felony:
A crime, typically one involving violence, regarded as more serious than a misdemeanor, and usually punishable by imprisonment for more than one year or by death.

Child:
A young human being below the age of full physical development or below the legal age of majority

Parent:
A father or mother

Grandparent:
A parent of one's father or mother; a grandmother or grandfather

Caregiver:
A family member or paid helper who regularly looks after a child or a sick, elderly, or disabled person

CHILD ABUSE/NEGLECT IN THE STATE OF FLORIDA:

827.03 Abuse, aggravated abuse, and neglect of a child; penalties.--

(1) "Child abuse" means:

(a) Intentional infliction of physical or mental injury upon a child;

(b) An intentional act that could reasonably be expected to result in physical or mental injury to a child; or

(c) Active encouragement of any person to commit an act that results or could reasonably be expected to result in physical or mental injury to a child.

A person who knowingly or willfully abuses a child without causing great bodily harm, permanent disability, or permanent disfigurement to the child commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(2) "Aggravated child abuse" occurs when a person:

(a) Commits aggravated battery on a child;

(b) Willfully tortures, maliciously punishes, or willfully and unlawfully cages a child; or

(c) Knowingly or willfully abuses a child and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the child.

A person who commits aggravated child abuse commits a felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(3)(a) "Neglect of a child" means:

1. A care-giver's failure or omission to provide a child with the care, supervision, and services necessary to maintain the child's physical and mental health, including, but not limited to, food, nutrition, clothing, shelter, supervision, medicine, and medical services that a prudent person would consider essential for the well-being of the child; or

2. A care-giver's failure to make a reasonable effort to protect a child from abuse, neglect, or exploitation by another person.

Neglect of a child may be based on repeated conduct or on a single incident or omission that results in, or could reasonably be expected to result in, serious physical or mental injury, or a substantial risk of death, to a child.

(b) A person who willfully or by culpable negligence neglects a child and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the child commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(c) A person who willfully or by culpable negligence neglects a child without causing great bodily harm, permanent disability, or permanent disfigurement to the child commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(4) For purposes of this section, "maliciously" means wrongfully, intentionally, and without legal justification or excuse. Maliciousness may be established by circumstances from which one could conclude that a reasonable parent would not have engaged in the damaging acts toward the child for any valid reason and that the primary purpose of the acts was to cause the victim unjustifiable pain or injury.

Therefore, this petition is requesting that a law be established to make it a felony under the law when a child, who is under the age of majority and the child is in the care of either a parent, grandparent, relative, family friend or a caregiver and:

1. Failure to report a child's death within an one (1 ) hour time period, upon the discovery of the death of that child.

2. Failure to report a child's disappearance within a specified amount of time 24 hours or less depending on the circumstances surrounding the disappearance.
