Due to the pressure put upon the Board of Regents by this petition and other influences by concerned alumni of NMMI, 2 positions on the Board of Regents have been vacated. Due to the fact that the positions vacated were two of the primary "negative forces" on this board, I feel our work is done. I consider the leverage this petition wielded to be a victory. My thanks to the hundreds of you that viewed it, and discussed it. I also thank you that supported my by signing.
The Board of Regents (the board) at New Mexico Military Institute (NMMI) have failed to meet the requirements of State Article 12, Section 21-12-3 : [Board of Regents;duty;educational standard.]
"It shall be the duty of the Board of Regents to maintain and control, at Roswell, a military institute for the education and training of the youth of this country, of as high a standard as like institutions in other states and territories."
Furthermore, the NMMI Board of Regents are accused of the following allegations:
1.) Incompetence - Due to the fact that they (the Board) did not properly vet and examine RADM (USN Ret) David Ellison's prior employment at the Naval Postgraduate School (NPS), which would have brought to light his controversial tenure at NPS.
2.) Neglect of Duty - In that they (the Board) have failed to respond to Ellison's counterproductive policies which have produced four straight years of student population decline (attrition).
3.) Malfeasance in Office - By egregiously violating the State of New Mexico Open Meetings Act.
We, the undersigned, call on the Supreme Court of the State of New Mexico, to invoke Article 12, Section 13, paragraph D, of the constitution of New Mexico, and remove the entire Board of Regents for New Mexico Military Institute.
The board has failed to meet the standards required by State Article 12, Section 21-12-3, by allowing student attrition to escalate yearly, and by allowing academic test scores to become lower than like institutions, and allegations of: Incompetence; Neglect of Duty; and Malfeasance.
