A German citizen is suing the Federal Republic of Germany for damages at the European Court of Human Rights in Strasbourg, France. In his opinion, Germany ignored and overruled an indisputable and final decision regarding his case by the Federal Constitutional Court in order to unlawfully put him under general suspicion and to deprive him of his constitutional and human rights. He claims Germany caused immeasurable harm.

On the occasion of his public discussion with the German news magazine DER SPIEGEL in January 2008 in Heidelberg, the president of the Federal Constitutional Court, Prof. Dr. Dr. Hans-Juergen Papier, pointed out that whereas the Federal Constitutional Court "cannot send the bailiff" – i.e., has no executive power, – "human dignity [already] has been compromised to the core [in Germany]." (1st and following paragraph).

The first article of the German Constitution defines Menschenwuerde (literally the dignity of a human being) as an indispensable, inalienable, and inviolable constitutional right; to respect and protect it is the duty of all state authority.

[ If the European Court of Human Rights determined that a violation as stated in the first paragraph had occurred, and if it wanted to remedy the complaint, would you, as a German citizen, be willing to contribute to a compensation a part in the amount of ten eurocent? - this question was replaced by the author with the question in paragraph 6 on April 8, 2009 - ]

With its decision from March 3, 2009, the European Court for Human Rights in Strasbourg rejected the complaint from July 2006 as inadmissible; in the Court's opinion, there was not even the appearance of a violation of the Convention for the Protection of Human Rights and Essential Freedoms, or of the Rights and Liberties guaranteed in its Additional Protocols.

The complainant maintains his claim that the Federal Republic of Germany has violated Human Rights. If conditions in Germany persisted as described in paragraphs 1 and 2, would you consider it possible that there exists a violation of Human Rights, perhaps even as defined by the Universal Declaration of Human Rights?
