Approximately 90% of all boating fatalities involve drownings caused by boating accidents. Most drowning victims are not wearing a PFD at the time.
SECTION 1. Section 5A of Chapter 90B of the General Laws, as appearing in the 2008 Official Edition, is hereby amended, by inserting at the end thereof, the following sentence:-
The operator of a boat under sixty five feet in length, on any water ways of the state may not transport a person regardless of age on the deck of a boat or in an open boat unless the person is wearing a United States Coast Guard approved Type I, Type II, Type III or V personal flotation device.
Exceptions when PFD does not need to be worn: When in enclosed area of a houseboat or cruiser, or within the area enclosed by railings on a party barge, cruise or houseboat or if the vessel is not underway ie; moored or at anchor.
