The Tenth Amendment provides that “powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

In Accordance to the Preamble of the West Virginia Constitution, Article I, Section 1 Article II Section 2, and Article III section 3 of the State of West Virginia's Constitution. It also Clearly states:

Preamble
Since through Divine Providence we enjoy the blessings of civil, political and religious liberty, we, the people of West Virginia, in and through the provisions of this Constitution, reaffirm our faith in and constant reliance upon God and seek diligently to promote, preserve and perpetuate good government in the state of West Virginia for the common welfare, freedom and security of ourselves and our posterity.

Article I
Section 1 Relations to the government of the United States.

The state of West Virginia is, and shall remain, one of the United States of America. The constitution of the United States of America, and the laws and treaties made in pursuance thereof, shall be the supreme law of the land.

Article II
Section 2 Powers of government in citizens.

The powers of government reside in all the citizens of the state, and can be rightfully exercised only in accordance with their will and appointment.

"All political power is vested in and derived from the people; all government of right originates from the people, is founded upon their will only, and is instituted solely for the good of the whole."

Rights reserved to people.

Government is instituted for the common benefit, protection and security of the people, nation or community. Of all its various forms that is the best, which is capable of producing the greatest degree of happiness and safety, and is most effectually secured against the danger of maladministration; and when any government shall be found inadequate or contrary to these purposes, a majority of the community has an indubitable, inalienable, and indefeasible right to reform, alter or abolish it in such manner as shall be judged most conducive to the public weal.

Whereas:
It is our belief that the federal government has consistently over-stepped its constitutional boundaries and usurped the powers reserved to the states, and therefore the people.

Whereas:
A West Virgnia Sovereignty Resolution will remind the federal government of its proper role and place.

Our Hope, our goal is; to have a resolution adopted and passed by the West Virginia State Legislature during the calendar year 2009.

Is West Virginia alone in this movement? The answer is clearly:No. There are no less than 32 states that are claiming and/or planning similar legislation.

The State Sovereignty movement clearly arises from the belief that the balance of power has tilted too far and too long in the direction of the federal government and that it’s time to restore that loose balance.

A Joint Resolution claiming Sovereignty under the Tenth Amendment to the Constitution of the United States,and Preamble of the West Virginia Constitution, Article I, Section 1 Article II Section 2, and Article III section 3 of the State of West Virginia's Constitution over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution.

We, the undersigned, demand that The State of West Virgnia's General Assembly pass a resolution claiming West Virginia's sovereignty In Accordance to the Tenth Amendment of the US Constitution, and the Preamble of the West Virginia Constitution, Article I, Section 1 Article II Section 2, and Article III section 3 of the State of West Virginia's Constitution during the calendar year 2009.
