Two (2) Million Kenyan Signatures Supporting Amb. Francis Kirimi Muthaura, Uhuru Muigai Kenyatta and William Samoei Ruto for Public &/or Electoral Office in Kenya.

Deputy Prime Minister and Minister for Finance, Hon. Uhuru Kenyatta and Ambassador Francis Muthaura are innocent until proven guilty in regards to ICC charges.

Calls for their resignation from Public Office by a section of civil society and some MPs are malicious and unfounded.The little knowledge i have about Kenya’s constitution, tells me that, these people calling for Uhuru and Muthaura resignation are doing so maliciously and maybe they havnt understood the constitution. The tenure of office for Uhuru is protected under the New constitution thanks to the old constitution. Article 262 (Sixth Schedule) on Transitional and Consequential provisions, subsection 12(2), states, ‘The persons occupying the offices of Vice President and Deputy Prime Minister or holding a position in the cabinet or as an assistant minister immediately before the effective date shall continue to serve in accordance with the former constitution until the first general elections held under this constitution unless they vacate or are removed from office in accordance with the former constitution and the National Accord and Reconciliation Act, 2008.’

Therefore, those quoting Chapter Six of the constitution for the resignatition of Uhuru and Muthaura are misinformed. In addition, for chapter six of the constitution to be operational, a legislation for effective administration of chapter six MUST be enacted (Article 80-a), which parliament has not legislated yet. Hence, it is hypocritical to call for Uhuru and Muthaura to resign simply because of allegations and malicious suspicions. If today i maliciously suspect person XYZ to have embezzled Kazi kwa Vijana funds, for my selfish gain, then we are going to have so many innoicent Kenyans victimised for nothing.

Let us not abuse the so called ‘ the spirit of the constitution; for selfish or political gain to eliminate competition. This will kill democracy which every Kenyan has fought for and is entitled to. I firmly urge Hon. Uhuru Kenyatta and Ambassador Francis Muthaura not to yield to malicious pressure to resign and stay put. the remaining option for removal of Deputy Prime Minister Hon. Uhuru Kenyatta, is described in the National Accord and Reconciliation Act, 2008, Clause 4 sub-clause 4 (b),which states, ‘The office of the Prime Minister and the Deputy Prime Minister shall become vacant only if – the National Assembly passes a resolution which is supported by a majority of all the members of the National Assembly, excluding the ex-official members, and of which not less than seven days notice has been given, declaring that the National Assembly has no confidence in the Prime Minister or Deputy prime Minister, as the case may be;’
