Because of a Massachusetts CORI law, I am being prevented from gaining employment in order to support myself and my wife who is, at the time I’m writing this, pregnant.

Because of this CORI law, I am in effect ineligible to gain employment not in the United States, but in FOREIGN COUNTRIES. Many foreign countries now require FBI national criminal background checks for employment visas, even if you are married to a citizen of that country.

Massachusetts is one of ONLY THREE states in the whole country that keeps fingerprint cards from a CORI on file permanently, even if the charge is a misdemeanor, even if the court outcome is not guilty, null prossed, or continued without finding (cwof), even if the CORI is sealed, even when the charges are no longer criminal offenses but CIVIL offenses, even if a pardon is granted, and even while a sealed record in a state is considered by the FBI to be expunged and would not show up on an FBI national criminal background check. And yes, all of the above circumstances apply to me.

This is my situation. Because of this egregious anachronism I am being prevented from obtaining a ‘clean’ FBI national criminal background check, which I need for employment to take care of my family.

I have been told by the Massachusetts Department of Criminal Justice Information Service office that I am not the only one in this situation, and the FBI has also indicated that I am not the only one in this situation.

IT IS TIME TO CHANGE THIS RIDICULOUS CORI LAW!

We, the undersigned, call on the Massachusetts General Assembly (State Legislature) to change this CORI law for keeping fingerprint cards and reporting sealed records to the FBI.
