WHEREAS a large literature and evidence base of scientific information exists (such as the World Health Organisation) on the growing and serious human health impacts and effects from excessive, unpredictable, uncontrollable and unnecessary noise and vibration; and
WHEREAS a recognized body of planning, management, scientific and technological knowledge exists by which sound and vibration may be substantially reduced; and
WHEREAS the people of Sault Ste. Marie (especially vulnerable populations)) have a right to and should be ensured an environment free from unusual, unnecessary, or excessive sound or vibration which may degrade the quality and tranquility of their life or cause nuisance; and
WHEREAS citizens in Sault Ste. Marie should have at their disposal an effective mechanism to redress any such unusual, unnecessary or excessive sound or vibration that causes health impacts or degrades the quality of their life.
WHEREAS other Northern Ontario, Ontario, Canadian and North American cities of similar size and demographics already have inclusive noise bylaws
WHEREAS a noise bylaw protects citizens with a tool for recourse that may be used without prohibiting certain activities (ie. it is flexible, fair, and functional).
THEREFORE:
The following residents of Sault Ste. Marie request Council establish a noise bylaw that achieves these objectives, and, specifically, maintains a quiet period of eight (8) hours (minimum) during overnight where exposure to a reasonably identified upper level of human-induced noise (measured in dBA at a set distance from source or at recipient) or vibration (standard to be determined) is prohibited in or abutting any residential area for any periods of time for any activities with exceptions being limited to emergency, municipal, provincial, and federal activities.
