The rezoning, proposed by Princess Anne Builders, goes to City Council in early September 2012. If the Council approves the request to re-zone the parcel adjacent to Marsh Creek it will:

- build 44 small residential houses on property that is known to flood.

- increase the number of residents that will be isolated during tidal flooding.

- circumvent the zoning ordnance and enable a communications tower placement in the middle of a residential neighborhood.

- increase traffic on Cedar Road during the Dominion Boulevard expansion project.

- add a hazardous road access on Cedar Road between a school access road (Artisan Ave) and a blind curve.

- result in a net negative total combined fiscal impact of $500,000 to city revenue per the Planning Staff Report (www.cityofchesapeake.net).

- build houses in the resource protection land in violation of the Chesapeake Bay Preservation Act (CBPA), and the City’s CBPA Board grandfathering rights will be lost.

- add to the overbuilding in Deep Creek and continue to lower the property values Chesapeake.

- add additional students to a school system that is already over crowded.

- eliminate a popular, and locally used, equestrian facility.

- add housing units to a local real estate market that is already flooded with existing and un-built properties and continues to decline.

This proposal is a resubmission of the rezoning attempt R(C)-06-16 that was disapproved by the City Council in 2007. The rezoning poses many risks to the homeowners in Deep Creek and the city of Chesapeake, and offers nothing in return.

As a citizen of the Deep Creek Community, or Chesapeake resident, I am concerned about the traffic hazard, combined fiscal impact, the building of homes on land not property suited and the potential impact on the environment, the egress of our residents during tidal flooding, the over crowding of our school systems, and the net effect on our cities real estate values and market.

Therefore: I oppose R(C)-12-08 proposal and oppose any rezoning of Parcel Number 0450000000060 from its current use as A-1 Agricultural District. I request a motion by City Council to ban future expansion of Marsh Creek and restrict future attempts for additional branching off of Artisan Avenue and Todd Lane.
