Make Litigation of Death Penalty Assured

Background (Preamble):
Whereas, the death penalty is under constant evaluation and debate, it is important to ensure that the places in which the death penalty is used follow specific procedures ultimately leading to the execution of the convicted.
This is important so that the death penalty as a deterrent of capital crimes can be accurately tested. Currently, according to the criminal justice report of 2007, the percentage of criminals sentenced to death that actually face execution ranges from less than 1% to 36% depending on the state.
While federally not all states have the death penalty and many continue to question there policies, it is essential that all capital cases are litigated for the purposes of evaluation.
