Petition Background (Preamble):
I've spoken to the Ministry of Labour and WSIB on the issue of WSIB mandatory coverage in the construction industry. There are a myriad of problems:

1.) Our voices were not heard, nor represented in the Public meetings they were slanted by individuals who said they spoke on behalf of all small-business owners (not so).

2.) They want to charge you a set rate per $100.00 on your GROSS Labour income and pay you 85% of your NET income. If anyone has a loss of even (MINUS) $1.00 what is 85% of a minus? Example: you earn $69,000.00 (working solo) your rate is 14% per 100.00 earned. Results: you pay $7,040.00 out on your GROSS PAY – your NET income is minus $1.00 so you get NOTHING if you are injured. If you take the same GROSS earnings above, and you have a net income of $5,000.00? You are paid 85% of that so $4,250.00 divide that by 12 months, and you will reap a whopping $354.00 per month from WSIB if they even believe your injury occurred at the jobsite and IT BETTER NOT BE on the jobsite on a Saturday or a Sunday because there is no WSIB coverage on the weekend.

3.) If you have Private Insurance which many of us do that is far more superior than WSIB on yourself, the Sole Proprietor, they are saying they will minus their payment to you by that amount. So it is just an extortion of our earning's!

4.) If 80% of your workload is that of a private home renovation, BUT you work for ONE builder/contractor you have to pay WSIB your percentage for your entire income. MOL/WSIB officials tell me they CANNOT regulate what work is being done for home owners. So if that is the case AND 80% of anyone’s work load is for home owners then WSIB should not be allowed any monies what-so-ever!

The ramming down our throats by Dalton McGuinty, the Minister of Labour and WSIB on this Bill 119 Mandatory Coverage in the Construction Industry and their threats of compliance is a threat sufficient enough to constitute extortion and certainly includes harm to the victims (sole proprietors in business) When the offence is committed by public officers, the penalty may include FORFEITURE of OFFICE. Under Statutes, the victim(s) of extortion may bring a civil action to recover pecuniary damages. Vie: lost income and wages; losses of the refund of premiums from private insurance companies covering the Sole Proprietor, and also costs associated with Business Closures due to this bill.

TO: The Legislative Assembly of Ontario

WHEREAS: Repeal all elements by Bill 119 Workplace Safety and Insurance Act 2008 from the First Session of the 39th Parliament; as it will put small businesses out of business;

WHEREAS: Stop the Extortion of Small-Business Owners in the Construction Industry; as it will cause undue financial hardship on Businesses;

WHEREAS: This Bill will do nothing to get to the underground economy in the Construction Industry;

WHEREAS: This Bill will do nothing to leveling the Playing Field in the Construction Industry;

WHEREAS: This Bill will do nothing to further Health & Safety in the Construction Industry;

WHEREAS: This Bill will cause undue hardship to Small-Business Owners;

I/WE the undersigned petition the Legislative Assembly of Ontario as follows: We, the Sole Proprietors/Independent Operators of Ontario, Repeal all elements by Bill 119 Workplace Safety and Insurance Act 2008 from the First Session of the 39th Parliament.

We strongly believe that the passing of this bill is an Extortion of small businesses across the Province of Ontario. None of us, one-man businesses or a business with a few employees had a say in this Bill, and we certainly were not fairly represented during the Public Consultations Regarding Bill 119 WSIB Mandatory Coverage in the Construction Industry. This will be a financial hardship on Small Businesses / Independent Operators who work alone and may employ an employee(s) when needed.

The representatives for Business owners in the Construction industry who spoke to this Bill 119 in the Legislature surely did not represent all Small Businesses of Ontario. Instead asking that their “Executives” be exempt from WSIB. Our voices, opinions, inputs were silenced by those who came before you all to represent all “small businesses” and they had no right to speak on behalf of all Small-Business Owners of Ontario!
