In Croatia basic human rights are constantly abused in court, because legislature and public administration issues i.e. processes before civil and administrative courts are mainly staged IF one party is a citizen of Croatia and other is an enterprise owned by Croatian state (for example "Elektra", which distributes electric energy charging for an installation amount... based on false invoice.
I was blackmailed to sign the statement that electric meter (a gadget which records the quantity and quality of el.energy used in a household) is owned by "Elektra" (and I personally had bought it at the market/shop!)..and that the gadget is functioning correctly i.e.according to a conventional standard. How can I - a lay person, middleaged female (retired lawyer) know (and know at the moment of the installation of that gadget - performed by "Elektra"'s employee/electrician!) whether an electric gadget is in "sound" condition?? This absurd lies and blackmailing are grave human rights abuse and, in the same time, criminal offenses. Furthermore I was charged with extremely high electricity bill ....after a period od extremely low electricity bills. Besides, the invoice for installation of electric wires and pipes stated false items...such as, quote: "works on el.pipes installation digging through a b r i c k wall"...while the wall was made of cement blocks!! So BLATANT , so obvious lies proved by material evidence did not impress Croatian "USKOK" - crime fighting state organisation( nor "Državno odvjetništvo" i.e. State Attorney) .....to undertake necessary steps....I emphasize that I have enclosed numerous material evidence.... There is N O RULE OF LAW IN CROATIA!!
Judges always defend the enterprise owned by a state ("Elektra"...etc) REGARDLESS material evidence and eye-witnesses and Logic!! Court verdicts are against citizens - always.. And the Court of Appeal confirms the decision of the first level Court - always. And it is IMPOSSIBLE to obtain a recusance of a biased judge!! This illegal rule is mainly confirmed by the Supreme Court ..and directly or indirectly approved even by the Constitutional Court!!
There are other cases of grave human court process rights abuse - proved by numerous material evidence!!
We, the undersigned, call on the UN to eliminate the corruption, human rights abuse and falsehood in the civil court procedures (the Municipal, the District Courts mainly ..but also present in the Supreme Court (regularly when state ownership or corrupted judges are involved!!) ...and finally in the practice of the Constitutional Court of Croatia where injustice and nepotism are strongly rooted..
