Free Political Prisoner Ali Moezzi

علی معزی زندانی سیاسی بند ۳۵۰ زندان اوین به علت ممانعت از رفتن به دادگاه به سلول‌های انفرادی بند ۲۴۰ زندان اوین منتقل و تا سه هفته ممنوع الملاقات گردید.

بنا به اطلاع گزارشگران هرانا، ارگان خبری مجموعه فعالان حقوق بشر در ایران، علی معزی زندانی سیاسی زندان اوین که بدلیل اینکه دادگاه انقلاب را مشروع، قانونی و عادل نمی‌دانست، سه بار از رفتن به دادگاه امتناع کرد، روز ۱۹ مهرماه به سلول انفرادی بند ۲۴۰ زندان اوین منتقل گردید.

علی معزی پیش‌تر در ماههای فروردین، مرداد و آخرین بار ۱۹ مهرماه سال جاری از رفتن به شعبه ۱۵ دادگاه انقلاب به ریاست قاضی صلواتی امتناع کرد.

مسئولین زندان اوین ضمن تهدید به تبعید علی معزی به شهرستانهای دوردست به خانواده علی معزی اطلاع داده‌اند که تا سه هفته وی ممنوع الملاقات است و ایشان حق دیدار وی را ندارند.

گفتنی است، علی معزی به سرطان مثانه مبتلا می‌باشد و در هنگام بازداشت در حال انجام دوره درمان پزشکی خود بود که بازداشت وی موجب ناتمام ماندن روند درمانی وی گردید و مسئولین زندان تاکنون هیچ‌گونه اقدامی برای درمان این زندانی سیاسی انجام نداده‌اند.

علی معزی از خردادماه ۹۰ تاکنون در بازداشت موقت به سر می‌برد و ۷ ماه را در بندهای ۲۰۹ و ۲۴۰ زندان اوین سپری کرده است. پرونده وی در شعبه ۱۵ دادگاه انقلاب به ریاست قاضی صلواتی به اتهام محاربه و هواداری از سازمان مجاهدین در حال رسیدگی می‌باشد.

معزی که حدود سه ماه و نیم را در انفرادی گذرانده به اتهام شرکت در مراسم یادبود محسن دکمه‌چی، علی صارمی و جعفر کاظمی بازداشت شده بود. جعفر کاظمی و علی صارمی، بیش از یک سال پیش در زندان اوین اعدام شدند و محسن دکمه‌چی نیز پس از ابتلا به بیماری سرطان در زندان رجایی شهر کرج و بدلیل عدم اعطای مرخصی استعلاجی بموقع جهت مداوا، درگذشت.

لازم به یادآوریست، پیش از این نیز، دادگاه انقلاب کرج، علی معزی را در پاییز ۸۷ به اتهام دیدار با همسر و ۲ تن از فرزندانش در اشرف به ۲ سال زندان محکوم کرده بود که وی حبس خود را در زندان رجایی شهر کرج سپری نمود.

Committee of Human Rights Reporters: Ali Moezzi, a political prisoner inside Ward 350 of Evin Prison who has been in "temporary detention" since June 2011, having spent seven months inside security wards 209 and 240 of the Evin facility, refused to attend his trial at the Tehran Revolutionary Court on 8 April.

Moezzi was arrested after he attended memorial services for political prisoners Mohsen Dokmehchi, Ali Saremi, and Jafar Kazemi, spent 3.5 months in solitary confinement. Jafar Kazemi and Ali Saremi were executed over a year ago at Evin Prison. Mohsen Dokmechi who suffered from cancer, died at Rajaee Shahr Prison after his requests for medical treatment or furlough were denied.

Previously, in 2008, Karaj Revolutionary Court had sentenced Ali Moezzi to two years in prison for visiting his wife and two children at Mujahedin-e Khalgh's Camp Ashraf in Iraq.

In a letter addressed to Branch 15 of Tehran Revolutionary Court, Ali Moezzi stated, "Because during recent years a number of my fellow countrymen were unfairly executed based on the unjust orders and rulings of Revolutionary Courts, I consider these puppet courts with their pre-determined rulings lacking in legitimacy, and I condemn the very judges and case-makers of these courts."

Evin Prison authorities reacted to Ali Moezzi's refusal to appear in court. Putting handcuffs on him, they prepared Moezzi to be transferred to court, but upon the political prisoner's insistence on illegality of the Revolutionary Courts, they changed their minds and returned him to Ward 350 of Evin Prison.

Many legal experts believe that based on the Iranian Constitution and early discussions at the Constituent Assembly, the Revolutionary Courts lack legal legitimacy (Articles 159, 172, and 173 of the Iranian Constitution). Several prisoners, such as Mohammad Seifzadeh, a founding member of the Center for Human Rights Defenders, and Abolfazl Ghadyani, a senior member of the Islamic Revolution Mujahedin, have boycotted the Revolutionary Courts because its trial are held behind closed doors and without a jury, against Article 168 of the Iranian Constitution and a note under Article 20 of the Formation of General and Revolutionary Courts.

Almost all cases of political prisoners during recent years have lacked conformance to law during investigation, arrest, and sentencing stages and suspects have been deprived of choosing an attorney and access to a fair trial.
