Equal rights over ancestral property

My name is Ravichandra, (age 33) residing at Kodigehalli near Sahakara Nagar. We have a land issue, I am posting this for first time, hoping someone helps me.

My mother want to claim partition in her father's land at Sonnenahalli behind govt hospital. The problem is, there were four sons and three daughters including my mother. The whole one acre land remained in the name of eldest son, but he died 15 years ago leaving the property into his wife's name.

Still she's continuing as a only one owner, and another brother got missed away 28 years ago, and we don't know where he is. But now there are two (2) sons, and one(1) widow also three(3) daughters.

But the two remained sons and their family went to court, to divide property into three parts, And they claiming that the three daughters have died when three daughters are alive with families but very poor and uneducated.

A) First of all they gone to court with false statement, and now they are telling that the B) females got no equal power over ancestral property.

What should we do now? Is there equal rites for male and females? If so, what's our next step to be taken, shall we go to court?
