Although EVMs are efficient, it is not transparent for the voter. The German Supreme Court held [p.80 at 144-54] the EVMs to be unconstitutional holding that transparency was a constitutional principle while efficiency is not. Germany now has returned to ballot papers.
7. I had prayed in my Writ Petition for issue of a Writ of Mandamus to the Election Commission to provide a printed or visual image to every voter to verify the vote he or she cast before exiting the polling booth.
8. The secrecy of the vote can be safeguarded by requiring that the printed voter received be deposited in a ballot box before exiting the booth.
9. If it cannot be done, then to return to ballot papers till it could be done.
10. The Hon’ble High Court has, after hearing me at length, acknowledged that[SLP p.22, paras 25-26]. The problem of EVM tamperability compared to ballot paper rigging is that the former can be made wholesale and unseen.

A voter collects a printout and just shows the back of the ticket and the two polling officers sign in original. Then the voter puts that signed printout in a special cover and inserts it in the ballot box.
For further info. in 11 commues = comstituencies, when the candidates’ rep alleged rigging. Immediately the ballot corss counting was done in the presence of a special magistrate and doubts were cleared!
So much for transparency and fairness in polling. ECI should revert to paper ballot until the Indian EVM is truly indigenous or a paper printout IS TREATED AS THE BALLOT and the entire EVM process is subject to the cyberlaw of the land.
Dr. Swamy mentioned the example of France in the SC today. SC has issued notice to ECI. Dr. Swamy has to succeed to save democracy in the country which gave the first ballot cf. Uttaramerur inscription of 12th century mentioned by T. Prakasam in Constituent Assembly debates.
