Economic Sanctions on Kenyan Government
Published by James Wabwire on Jan 29, 2008
Target: Flower Industry and any other business owned by Kibaki friends
Region: Kenya
Web site: http://Kenyahumanrights.org
Background (Preamble):
The Kenya electoral law is not completely guided by the law. Part of the electoral law has parts of it negotiated without necessarily being enforced by the constitution.
This state of affair gives the President of Kenya the right to act unilateraly. The current situation in Kenya could have be averted if the President could have appointed the Electoral Commission of Kenya is consultation with the Opposition.
In 1997 the President then, did consult the Opposition through the IPPG-Inter Parliamentary Party Group. This arrangement made President Kibaki a beneficiary of the goodwill gesture by the IPPG. Today Kibaki has trumpled on the rights of Kenyans with Impunity. He has muzzled the media, breached the freedom of expression, the right to protest, freedom of movement, issued a shoot to Kill directive to police in selective areas in Kenya, affected the livelihood of millions of Kenyans through a fraudulent election process.
It is therefore not possible for Kenyans to resolve the problems facing them because President Kibaki has appointed his cronies to head the Judiciary and therefore legal redress is just but a sham in Kenya. He has banned any form of mass gatherings and therefore making it difficult to mobilize any form of protest however peaceful.
Kenyans are every day being pushed to a corner to resort to unorthodox means to make their grievances heard. It is with this background that I petition the international Community; The European Union, The African Union, COMMESA, East African Community, IGAD and the United States to isolate Kenya as a mechanism to exert diplomatic pressure on Mr. Kibaki to respect the rule of law, democratic freedom and Human Rights of Kenyans.
President Kibaki was not elected President of Kenya, he is exercising the executive authority by the nozzle of the gun and fraudulently.

Petition:
We the undersigned, call on the UN, EU, AU, IGAD, COMMESA and the US to diplomatically Isolate the Government of Kenya.
The Government of Kenya as Currently Constituted does not represent the aspirations of majority of Kenyans who voted 26 Ministers of 34 of the Kibaki government out of parliament. ODM the opposition party has the majority of seats in parliament.
Under our constitution ODM should form the government. However, Mr. Kibaki fraudulently crafted an illegitimate government by coopting Mr. Kalonzo Musyoka who miserably lost in his bid to the Presidency. It is a coalition for convenience and does not in any way address the aspirations of Kenyans. Kenyans, until now have no idea how the post election pact between ODM-K, PNU and KANU was made. What principles were the bedrock for the coalition. How these competing parties were able to converge their divergent policies in a record of 5 days after the fraudulent elections.
Kenyan people are frustrated at the lack of information, inability to meet and discuss freely, they are frustrated by a corrupt Judiciary and equally brutal police force. It is these frustrations coupled with selective and preferential treatment of certain communities and the expense of the taxpayers that has led to the violence you see in Kenya today.
We call upon you friends of Kenya to isolate this fraudulent government, even as we mediate to solve the crisis; to use international law standards to demand that Justice be done in Kenya. Otherwise Kenya will become yet another statistics in the failed states. Indeed, if the agenda of a party is to stay in power irrespective of the views of her citizens then, such a people can as well bid goodbye to a Nation. The Kenyan People are bruised and are counting on your support to reinstate their democratic right - the Right to Life.
