Commonwealth of Puerto Rico Request for waiver of certain provisions of the act are reviewed by the United States Maritime Administration on a case-by-case basis.

Waivers have been granted in cases of national emergencies or in cases of strategic interest.

Nevertheless, studies by the World Economic Forum and Federal Reserve Bank in New York have concluded that the Jones Act hinders economic development in the commonwealth of Puerto Rico. In the wake of Hurricane Katrina, Homeland Security Secretary Michael Chertoff temporarily waived the coastwise laws for foreign vessels carrying oil and natural gas from September 1 to 19, 2005.

Puerto Rico is respectfully requesting a waiver for transports of goods and gasoline via trade or navigation of coastal waters and aviation within its territory in the context of Cabotage Right.

Puerto Rico understands that with a requested wavier of 10 years it can have the economic possibility to get out of debt 72,000 million.

If Puerto Rico were to be granted this waiver of the Jones Act of 1920, section 27 of the Merchant Marine Act of 1920, Puerto Rico could receive products from all over the planet without restrictive quotas without paying fees and taxes that often double the price of the product.

The waiver would allow emergency shipment of gasoline and oil to lower energy bills and lower food prices.

This request will be under the supervision of Home Land Security or any other means the United States deems necessary with the collaboration of the Food and Drug Administration as well as USDA.
