My petition is regarding my story that began on June 7th 1998. My mother Judith Johnson was brutally murdered and raped in her home. My 6 year old niece who was spending the night was attacked and raped and left for dead.

She survived her attack and told police "It looked like my Uncle Clarence" (Elkins), my husband at the time. He was wrongfully convicted. I spent 7 1/2 yrs proving his innocence and proving who the murderer was. Clarence was exonerated in 2005 and Earl Mann was convicted after confessing in 2008. Clarence was compensated through the state of Ohio for wrongful conviction. We then filed and settled a civil suit against the Barberton Police Dept in 2010. The IRS is trying to tax that money now.

This Government entity is now trying to sue for taxes from the man they wrongfully put into prison. And bully the family that was left behind to get him out! Please help and set an example for the next family that will endure this pain.

Federal tax law does not have a law on the books that pertains to Wrongful Conviction on settlement and/or a civil suit won by Jury of a federal entity.

The law that is stated, refers to any physical injury incurred, taxes are exempt.

Please sign this petition for an amendment of that tax law to read that Wrongful Conviction is a very real physical injury to not only body but mind.

It should therefore be considered non-taxable on a federal level.

We the undersigned, call to congress to ammend the Federal tax law pertaining to Wrongful Conviction as a physical injury and exempt from tax liability.
