Bill C-37 has created a second class of Canadian citizens by denying rights granted to any other Canadian citizen from those whose citizenship was realised through international adoption.

The Bill denies these Canadian citizens the right to create their own families through international adoption and have these latter children recognised as Canadian citizens, and further it denies citizenship to any child born to an overseas adopted Canadian citizen who has their child on foreign soil.

The legislation further discriminates in that employees of the Federal government or the armed forces are exempt from the regulations, yet a private citizen, who through the course of their employment or for any other reason (such a holiday or family emergency) who gives birth to their child on foreign soil, will not be considered a Canadian citizen, and could, depending on the circumstances thereby become a stateless child, as many nations do not grant citizenship to a person simply because their where born in the country.

PETITION TO THE HOUSE OF COMMONS ASSEMBLED IN PARLIAMENT;

We the undersigned, Citizens of Canada, draw the attention of HOUSE OF COMMONS elected in PARLIAMENT to the following;

THAT, Bill C-37, also known as the Canadian Citizenship Law, is unjust and discriminatory to a bona fide portion of legally recognized and acknowledged Canadian Citizens:

THAT this bona fide group is those children adopted from a foreign nation by Canadian citizens;

THAT this bona fide group has met all legal requirements to become a Canadian Citizen;

THAT this bona fide group meets all the tests and responsibilities of all other Canadian Citizens who reside in Canada and pay taxes;

THAT as proposed, BILL C-37 denies these Canadian citizens, in contrast to all other Canadian citizens, the right to create a family through international adoption and have their adopted child become a Canadian Citizen;

THAT as proposed, BILL C-37 denies these Canadian citizens, in contracts to all other Canadian citizens, the right to have their child recognized as a Canadian citizen if they are born of foreign soil, thereby making these latter children in effect stateless and unrecognized by an any nation, which is an affront to humanity;

THAT as proposed, BILL C-37 is discriminatory in that employees of the Federal Government and it’s agencies are exempt from these rules, but private citizens who are pursuing their right to employment and self fulfillment in the private sector are subject to the rules;

THAT BILL C-37 fails to establish any form of residency duration on Canadian soil to determine the applicability of these rules;

AND THAT as such this law is unjust, inhumane and unconstitutional in that it arbitrarily attempts to deny rights granted to any other Canadian citizen based solely on the citizen’s place of birth, and as such creates a second class of Canadian citizen by singling out adopted children as being subject to a different set of rules.

THEREFORE we the undersigned electoral voters call upon the House of Parliament to amend Bill C-37 to eliminate these rules or, at the minimum, amend these rules such that a realistic and defined residency status is used in the determination of the applicability of these rules.
