Petition for Access to Russian River

Background (Preamble):
RE: Walking access to the Russian River from Southern Ave. (aka Drake Road) & Northern Ave.
Guerneville River Enthusiasts:
The fence around the “Drake Road Orchard” blocks the public access to the Russian River. By law, we have the right to pass through the property as we have been continuously doing so for several years (5+).
We are all entitled to “prescriptive easement rights” (meaning continued permanent access to the river) and may continue to use this access indefinitely per California Civil Code 813.
However, before pursuing legal action, we are joining together in this petition as good neighbors to give the property owner an opportunity to install gates and restore access to our river pathways.
Please sign this petition if wish to have river access continuously throughout your lifetime for yourselves, friends and family. Should you wish to be updated or to contribute financially, please contact access.river@yahoo.com.

Whereas: The property owner of 14775 Northern Avenue, Guerneville, CA 95446 has installed a fence at the site of two passageways to the Russian River, on the 9.46 acres between Northern Avenue and Southern Avenue (aka Drake Road) preventing continued use and enjoyment of the River by residents and vacationers of the City of Guerneville.
The undersigned request the following action be taken: That the aforementioned property owner install two gates for access, one on Southern Avenue (aka Drake Road), Guerneville, CA 95446 and one on Northern Avenue, Guerneville, CA 95446 directly in front of the river access pathways in order to allow residents and vacationers an unrestricted pass-through for their continuous enjoyment of the hiking trails and access to the Russian River.
