We must have more of a 'Burden of Proof', that is to say the accuracy of 3rd party reports should be thoroughly scrutinised as it would be e,g, ordinarily in a Criminal court etc. In any case It would be reasonable for anyone prior to consideration of detention under the MHA to have a full and comprehensive psychological assessment, rather than psychiatric assessment per se, in order to gain a full accurate complete insight of a persons current circumstances and history.
