BEST INTERESTS OF THE CHILD
The law is clear: the paramount consideration in family court custody disputes is the BEST INTERESTS OF THE CHILD. Yet judges routinely ignore this Legislative directive and use child custody and visitation to punish unrepresented litigants who assert their rights, or in any way question the authority of a judge.
Prisoners and sex offenders often have child visitation rights greater than the rights of a law-abiding parent. Judges routinely restrict or terminate the custody and visitation rights of law-abiding parents simply because the parent asserted lawful rights, or offended a thin-skinned judge.
Judges use child custody and visitation rights as a bludgeon of control over the indigent who cannot afford counsel. The best interests of the child, and the parent’s fundamental constitutional right of familial association are not a consideration.
The Court’s intended purpose was designed to serve families and children, but it has been taken over by for-profit attorneys and those employed in the divorce and custody industry.
