Petition Requesting the Marblehead Board of Selectmen to Support, and Fully Defend, the Marblehead Zoning Board of Appeals’ decision to deny a Special Permit for an Assisted Living Facility known as the “Mariner” in a lawsuit in Massachusetts Land Court.

If the Marblehead Board of Selectmen directs Marblehead Town Counsel to not defend (or does not approve funding for the defense) of the Town and the Zoning Board of Appeals in Massachusetts Land Court in a lawsuit filed by the “Mariner Applicants,” it could set a precedent that could negate every decision made by the Zoning Board of Appeals and open the Town up to thousands of lawsuits by every applicant not satisfied with a ZBA decision, which could potentially cost the Town of Marblehead Millions of Dollars and possibly bankrupt the Town.
We, the Marblehead Residents listed below, request the Marblehead Board of Selectmen to direct Marblehead Town Counsel to fully defend the Town of Marblehead and the Marblehead Zoning Board of Appeals (and to fully fund the effort) in a lawsuit in Massachusetts Land Court initiated against them by the “Mariner” Applicants following the ZBA’s 5 to 0 decision to deny an exception to existing Marblehead Zoning bylaws.
