The State allows the tenants to remain in your property for an undetermined amount of time as long as the weather forecast has a 20% chance of rain. During this period you are not collecting rent, but the tenant has access to your property.

The landlord is actually supporting the tenant and their family at the landlords expense. While this rule or law is humanitarian one it causes undue financial strain on the already low profit margins in the rental market. By the way I can't locate any reference material under chapter 27 landlord/tenants act that supports this process in Barnwell County.

The way the laws are set up is very detrimental and discriminatory towards the landlords. The tenant may destroy the property, not pay rent, in some cases utilize utilities and water at the landlords expense as well as act so badly that good rent paying tenants leave. All this without repercussions to the bad tenant. Even when the tenant and landlord go to court and the landlord wins a judgment, the landlord still cannot collect on the debt. The court fees are only for the landlords to pay as are the lawyers fees.

Therefore the landlords have very limited rights to their very own property that they are expected to pay annual taxes for without receiving a break from the local city and county tax authorities. Landlords have actually lost their properties due to the cost of repairing once these tenants are finally removed from their property.

Landlords need a way to collect their outstanding debts, just as the local government can collect their taxes. The city of Barnwell needs to consider the financial burden they put on small business owners who are trying to add to the tax revenue here.

We, the undersigned, call on the Government of the State of South Carolina to change the landlord/tenant laws so that once a landlord has been granted a Writ of Eviction and have paid the magistrate/constable for a set out date, that it should be carried out within 3 days, period.

The landlord should not be subject to an act of God, something that he/she has absolutely no control over. Insurance companies are excluded from acts of God and so should landlords be exempted from this unfair rule/opinion or law. The landlord already pays for taxes, mortgages, insurance, normal wear and tear, and also do the maintenance.

The Tenant should pay the rent on time and if they elect not to pay then their rights to the landlords property should end very swiftly. This act would hold them to the same standard as that of the landlord.
It is time for equality for landlords, and the laws changed so Landlords aren't held prisoners, while our income is reducing, and yet our taxes are increasing by the State of South Carolina.
