Rezoning Protest Petition of the unplatted tract of land lying in the Northwest Quarter of Section 21, Township 13 South, Range 23 East, in the city of Olathe, Johnson County, kansas.
A developer has filed applications for a Preliminary Plat and Rezoning Plan for the above referenced plat of land. We understand that the developer is proposing rezoning the tract from City Rural to Residential-1. The tract of land, as evidenced from aerial photography, is entirely woodland with Little Cedar creek flowing on the northern end to the eastern end.
The unchecked development and sale of subdivisions of this land has the potential to eliminate most if not all the woodland. This woodland provides value to the homeowners on Mesquite Drive, Kenton St. and Kenton Drive, that have views from their homes. In addition, this woodland is home to wildlife such as deer and wild turkey.
We, the undersigned property owners, do hereby protest the rezoning plan of the above referenced tract of land from Cty Rur to R-1. We are owners of real property located within the statutory area of notification related to the area for which a rezoning is sought.
A significant factor in the purchase of our property in the Forest View Subdivision was the view and privacy of the woodland in the subject tract. The views provide significant value to our investments in our homes. We believe that unchecked development of the subject tract into residential subdivisions will adversely impact the value of our homes.
We respectfully request that the Olathe Planning Commision require the developer, submitting the rezoning request, to include a Tree Preservation Easement of a minimum of 30 feet along the entirety of the West and South boundaries of the subject tract and on the ridge line above Little Cedar Creek. A Tree Preservation Easement requirement will ensure woodland tree canopy preservation, in keeping with City Ordinance 09-22&14, 2009.
