Whereas, on May 16th, Paul John, Executive Director for GIADA (Georgia Independent Automobile Dealers Association) presented a proposal to the Georgia Used Motor Vehicle Dealers Board at their meeting.

The proposal, in summary, was that the Board take action to modify the rules in such a way that Administrative Offices (auto broker offices) for used car dealers as an established place of business WOULD NO LONGER BE ALLOWED GOING FORWARD as an approved business location for Auto Brokers.

To be perfectly accurate, the proposal included grandfathering in existing brokers, nevertheless, this proposal would SEVERLY LIMIT used car dealers business going forward. If a used car dealer without a lot (auto broker) ever had to relocate the business under any circumstances, or temporarily depart the office, then that broker is out of business as an Auto Broker PERMANENTLY.

The proposal does not allow dealers with car lots to change business model to auto brokers.

Furthermore, this rule, specifically targets the small businessmen and businesswomen in our industry, and is unfair and detrimental to legitimate participants in the legitimate Auto Broker industry.

As presented, the proposal will eliminate wholesalers, and those who sell cars by special order. It also clearly stifles competition. The proposal is anti-business, unfair, hurts the consumer, and is seems to be intended on protecting the larger used dealer lots at the expense of the smaller dealers.

And whereas, GIADA’s proposal to the Board was that in order to obtain a license, an applicant must have an established business location that included a MANDATORY DISPLAY AREA FOR MINIMUM 10 CARS (in almost all Georgia jurisdiction a car lot),

We support the following:

1) We Strongly Oppose the GIADA’s proposed initiative as presented to the Board on May 16th to mandate a 10 car minimum display area for Used Car Brokers in Georgia.

2) We are in favor of initiatives spearheaded by the GIADA in the past which have targeted only those illegitimate operators for illegal practices such as Curbstoning, but we operate our business in a lawful manner… and this rule change could eliminate the future mobility of my business and cripple the Legitimate Auto Broker industry in Georgia for future entrepreneurs wanting to enter the used car business, as well as hurting the Georgia consumer. We support measures to strengthen the enforcement the legal practices of used car dealers with AND without car lots.

3) We feel it is the duty of the Georgia Used Motor Vehicle Dealers Board to protect ALL used car dealers (with and without lots), as well as the Georgia consumer, not just a select group of business within the used car industry. We feel GIADA is not representing all used car dealers, which include auto brokers that have only administrative offices.
