Mr. Fitzgerald has been incarcerated under a life term for 42 years now, even though he has now been eligible for parole for over 30 years. In 2008, the Board denied parole to Mr. Fitzgerald despite the failure of evidence that he represented a clear and present danger.

At the hearing, Mr. Fitzgerald showed that he has never been charged with a violent infraction during his long incarceration, he has participated in innumerable rehabilitative programs, been trained in several vocational fields and fulfilled all work assignments.

Moreover, the Board commissioners during the last July 2008 hearing challenged Mr. Fitzgerald to renounce the political views he held at the time of his initial incarceration when he was a member of the Black Panther Party, we believe the denial was politically and racially motivated. Its denial was, therefore, unlawful.

In 1998, he suffered a stroke, and, as a result, remains partially paralyzed. On April 11, 2012, he will be 63 years old. In consideration of all of the above and in the absence of any concrete evidence that Mr. Fitzgerald presents a danger to society, we are respectfully urging you to advocate for the reversal of the Board’s politically-charged, unlawful, denial and grant immediate parole to Mr. Fitzgerald.

We, the undersigned, respectfully urge the California Board of Parole Hearings and Governor Jerry Brown to release Mr. Romaine Fitzgerald from prison immediately for the following reasons:

* Mr. Fitzgerald has served 42 years in prison, more time than his murder sentence prescribes.

* He poses no clear and present danger to society.

* He has demonstrated his remorse for his offense and participated in and completed every rehabilitative and self-help program available in the California Department of Corrections and Rehabilitation.

* He has several offers of employment in the Southern California area, including work related to his extraordinary writing skill and talent.

*He recently lost his 94 year old mother in December of 2012.

* He has a decent and loving home with his sister to which to return, as well as offers from other family and friends of alternative housing.

* Denial of Mr. Fitzgerald's parole would not be in keeping with the spirit and the letter of the court's order in the case pf "In Re Rutherford now In Re Lugo," as well as many other court decisions. Furthermore, the denial of Mr. Fitzgerald would not honor the the Supreme Court ruling in May of 2011 that California prisons must drastically reduce overcrowding in the next two years by releasing 30,000 inmates including the serving life sentences who are eligible for parole.
