As heirs to Land Commission Award 3386, we assert our family's unextinguished interest to the lands that the County of Maui and Kaehu Bay LLC claims to manage. Our kuleana to the area arises from Kalili and Pehuino who secured the original allodial title in 1839. The ʻohana continues to perform Hawaiian birth and burial rites on the land as well as subsistence living and gathering practices at sea.

In 2012, the County of Maui allegedly purchased 64 acres in Paukūkalo, Wailuku with the aid of the Trust for Public Land and Kauahea Inc. The legitimacy of the purchase remains encumbered by our family's pre-existing interests granted through LCA 3386. The failure of representatives from these agencies to consult with the family on our terms prior to expanding their project constitutes a belligerent trespass.

The funding requested for the development project proposes to create a cultural center for Hawaiian practitioners at Kaehu Bay. We are not opposed to individuals attempting to restore Kanaka Maoli cultural practices in the area. Our concern lies with the project's false claims to proprietorship.

We demand that the County of Maui defund the $75,000 budgeted to the development project managed by Kaehu Bay LLC. The project's alleged purchase of the Kaehu Bay area trespasses upon the legal interest of heirs to Land Commission Award 3386, a title claim established since the 1839 Mahele. By signing the petition, you are urging the County Council to divest from all present and future activities that would violate our family's right to occupy, manage, and live on our lands.
