Allow variance for placing previously installed above ground pool closer then 10 feet from house

My swimming pool that was installed in 2003 had to be taken down due to a code violation. Even though a permit was obtained the installers placed the pool too close to the underground power line. I was unaware of this code violation untill I had a fence placed around my backyard approximately six years later.

I had my pool taken down at the end of the summer season in 2010 and placed it in my garage for reinstallation in 2011.

While attempting to obtain a permit in May 2011 for the reinstallation, I was told that my lot was not wide enough and a permit was denied. This is after my pool had been up for over 8 years without incident.

My pool was originally located on the north section of my lot so I called Com Ed to get a quote as to how much it would cost to move the underground power line that runs diagonally through the south side of my lot. The cost of moving this power line would be in excess of ten thousand dollars. I simply cannot afford this.

I am now requesting a variance allowing the installation of the above ground swimming pool approximately 20 inches closer to my house, then dictated by code.
