31. The Urgent need to constitute NITA-U Professionally

The National Information Technology Authority, Uganda is a Government body that was setup by an act of parliament to coordinate, promote and monitor IT development within the context of national social and economic development.

The NITA-U Bill, 2008 was assented to on 15th July 2009 and a Statutory Instrument put NITA-U into operation as of 15th August 2009; a Board was also duly approved by Cabinet.

While we in the ICT community were happy with these developments and ready to move and see this institution in action, we got disappointed with the following:

1. Word went out that some members of the board were actually also positioning themselves to do big business with the Ministry of ICT under the NITA-U run projects like the FIbre backbone.

2. One of the board members who happens to be a commissioner in the ICT ministry was recalled by the Minister of ICT under Unclear circumstances.

3. The position of Executive Director which is supposed to have been advertised never was. Instead the board was leaning towards handpicking connected people to fill this portfolio.

We can not continue sitting back and watch as things go hay-wire in such a sensitive Government institution that is so dear to us Ugandans. It is in line with this that we need to sign a petition that shall be communicated to the authorities that be so they can know that we are watching and following their every move.

33. End politically motivated violence against women in Zimbabwe

In 2008, it is estimated that more than 2000 women of all ages were abducted, raped, tortured, and beaten across Zimbabwe for their political affiliations. Local police have said they don't handle political cases and have ignored these women's pleas for protection and justice. There has also not been any attempt to address these crimes at the national level.

Help ensure that the Zimbabwean government ends politically motivated violence against women, put a stop to impunity for these crimes, and bring the perpetrators to justice as stipulated in both SADC Protocol on Gender and Development and the Zimbabwe Global Political Agreement (GPA).

34. Put Homophobia/Homosexuality on the SADC/AU Agenda

It is widely known that member states of the Southern African Development Community (SADC) and the African Union (AU) have blatantly homophobic laws. In countries such as Uganda, Zimbabwe and many others, members of the Lesbian, Gay, Bisexual and Trans (LGBT) community are imprisoned, tortured and murdered because of their sexuality.

Not only does the law of these countries allow such atrocities to be committed, but the allies of these states do nothing to stop it. South Africa is a model of civil rights. Although we might not always be safe, our rights as human beings are written down and guarded by the Constitutional Court.

Our government, the most powerful and influential of SADC, and possibly Africa, has a duty to the region to uphold the rights of all people, not just South Africans. They have failed the LGBT community before when they failed to sign the United Nations Declaration to decriminalise homosexually. We cannot allow them to fail us again.

35. Save the Vredefort Dome World Heritage Site!

In 2005 Unesco approved the citation of the Vredefort Dome as a World Heritage Site (WHS), and the SA government undertook to formally recognise and regulate the area. The Dome is at the centre of the oldest and largest visible meteorite impact site on earth. We need to petition government to go forward with the WHS as planned.

As many people as possible should sign this petition to prove that there is overwhelming public support for conservation, the protection of heritage, and sensible economic development for the benefit of all.

Jan van Aardt, a puppy breeder has been running disgusting puppy mills for the past 9-10 years.. An organisation called Wet Nose Animal Rescue has stepped in an conviscated 94 dogs so far.. Many of them having cancerous growths and tumors.. And some of the conviscated dogs have died..

Wetnose are planning to prosecute Mr van Aardt, and the maximum punishment is R60 000.00 fine or 2 years Jail Time. He NEEDS more punishment than that!!

40. Lobby for additional Fertilizer and Grain Handling Facility in Mombasa, Kenya

Bulk grain chronology of events:

1) In year 2000 KPA grants a 33 year bulk grain and fertilizer license to Grain bulk handlers ltd.The license restricts other handlers from handling bulk grain at the port until 15th February,2008, i.e effectively a monopoly for 8years. The license is described as skewed by 2 transport ministers: Hon. Michuki and Hon. Makwere on the daily newspapers. Parliamentary investments committee in their report recommend competition.

2) In 2007,Grain bulk ltd. applies to KPA to extend the monopoly for another 25 years which is rejected by KPA, and KPA board proceeds to resolve that a tender for a 2nd bulk grain facility takes place.This news was greeted with relief as the monopoly operator charges usd 16 per ton while in Egypt for the same type of machinery, the operators charge usd 5 per ton. This comparatively higher handling cost is being passed on to the consumers.

3) After advertisement of the tender, there was surprise to learn of tender cancellation. The reason of 1000 workers losing jobs is a surprise. What the process entails is that the same workers will be carrying out loading manual work at the 2nd facility instead of at the port. This is what the monopoly bulk operator is doing presently as well. So there’s is no issue of job losses. Indeed the Kenya Union of Commercial Food and Allied Workers can attest to this as per attached annex 1. The reason of job losses was merely meant to justify the cancellation. In any case how does one hold millions of Kenyans ransom because of 1000 people? The 2nd facility will in fact create jobs by way of administration staff, technicians, finance staff, drivers, machine operators, technicians, etc similar to the present monopoly operator.

4) The issue of investments by the monopoly holder has presently no basis. It will be recalled that the monopoly holder was given a monopoly for 8 years, during which time he recouped his investment. Having been denied a monopoly extension for another 25years, the monopoly operator now wants to use the investments story. The remaining portion outstanding was after the monopoly operator wanted a further 25 years monopoly that he made a unilateral expansion programme without a binding written KPA commitment to extend the monopoly and now wants to demand a monopoly extension after it had been officially rejected. The majority of the bidders for the 2nd bulk facility have individually indicated that they are not going to demand any protectionism of any kind from the Government as the business is viable and can sustain 2 facilities. Several African countries have 2 or more than 2 operators. Sudan is currently constructing its 3rd grain facility.

5) When vessels arrive, the sole bulk grain operator has on several occasions been unable to cope with the inflow of ships, resulting in huge demurrages which the millers are forced to pass on to consumers. The demurrages range from usd 30,000 to usd 75000 per day! To illustrate, we append a schedule of vessels which were on hold for several days:

If we take the above schedule and use just an average delay of 3 days multiplied by an average Usd 40,000, multiplied by an exchange rate of ksh 77/= per dollar times the 11 ships is equal to Ksh 101,640,000. This is what is being passed on to Kenyan consumers! Can you imagine the cost? The information above can be independently verified from KPA records, shipping agents, millers and world food programme. In fact the World Food Programme is also complaining due to demurrages as a result of ship delays. They have indicated that the delay is causing them to overshoot their budget in terms of demurrages to owners of ships which means proportionately lesser subsequent relief maize, etc. In effect the monopoly is affecting even the most vulnerable and needy!

43. Reinstitute Operation Wembley in Uganda

A few years ago, there was an increase in the levels of violent crime in Uganda, with deaths being reported almost every week in both the electronic and print media.

Operation wembley was instituted by the Government of Uganda to curb this increase in crime levels, within weeks, the Operation had achieved the targets is set out to achieve, with the most violent crimes reduced tramendously.

Following its successes, and a reduction in the levels of violent crime to a level the police could keep in check, Operation Wembley was disbanded.

In the few months past in Uganda, there has been a resurgence of violent crimes, to unprecedented levels, more than the Police Force can handle, similar to the situation before Operation Wembley was instituted.

The purpose of this petition therefore, is to call upon the Government of Uganda to reinstitute Operation Wembley to curb on these violent crimes before we are robbed of more citizens.

Crisis? What crisis? The tragic consequences of Mbeki’s ‘do-nothingism’

Last Saturday afternoon, on the tarmac of Harare International Airport, the presidency of Thabo Mbeki hit its lowest ebb. The image of Mbeki holding hands with Robert Mugabe published alongside the headline “Crisis? What crisis?” destroyed whatever credibility Mbeki still held as the chief proponent of an African Renaissance.

Yesterday, Mbeki did it again. When he was asked about the 77 ton shipload of Chinese weapons in the Durban Harbour destined for Zimbabwe, he replied: “What weapons? I think you should ask the Chinese. There might be a consignment of coal that is being exported to the Congo or something. It is a port, those weapons would have had nothing to do with South Africa.”

His response to the Zimbabwe crisis typifies the denialism and ‘do-nothingism’ that has become the hallmark of his Presidency. It echoes his now infamous denial of the Aids pandemic and his response to the growing narcotics crisis in South Africa. “What is Tik?” he asked at an imbizo last year.

It also reflects his view on crime, which many South Africans regard as the biggest crisis of all. “Nobody can prove,” said Mbeki, “that the majority of the country’s 40 to 50 million citizens think that crime is spinning out of control”. Similarly, in 2006, when challenged about South Africa’s electricity generation capacity, he responded “There is no crisis….whatever needs to be done…is being done”.

Mbeki’s capacity for denial is his greatest failing as a leader, and it will define his legacy. It is an even greater failing than the other hallmark of his Presidency, the growth of racial nationalism. Denialism will eclipse his considerable contributions in the arena of macro-economic policy.

Mbeki’s instinct is to deny a problem and do nothing, until he is forced to apply retrospective crisis management. His insistence that a “normal electoral process” has been followed in Zimbabwe, is a classic example of this pattern.

The mind boggles when one considers the damage that could be done with the consignment of rocket launchers, grenades and semi-automatic weapons that are sitting in the Durban harbour.

Mbeki’s denial and do-nothingism infects government office-bearers across the board. When I was in New York last week, I met with our Ambassador to the United Nations, Dumisani Kumalo. I urged him to use South Africa’s position as rotational Chair of the Security Council to address the crisis in Zimbabwe.

Lately, it seems that Kenya Airways is having a very hard time transferring luggage from one flight to the next when making a connection thru Nairobi - even with multiple hours between flights - resulting in delayed luggage of one/two days.

What is even more frustrating is that KQ seemingly cannot provide adequate security at the JKI airport, resulting in pilfered luggage, which KQ then does not take responsibility for.

48. Kibaki Must Step Down

The international community is very much aware that Mwai Kibaki and his Party of National Unity (PNU) rigged the December 2007 Kenyan presidential election.

In recognition of this fact, the European Union, Britain, and the United States have refused to recognize the Kibaki government as legitimate.

As members of the international community, we do not intend to allow this blatant act of disregard for the rule of law and for the will of the people of Kenya to go unchallenged.

The list of evidence of election irregularities compiled in this petition contains widely known facts and has been corroborated by various news sources.

1) All polls taken before the election favored Raila Odinga and his party, the Orange Democratic Movement (ODM), with Odinga leading Kibaki by a margin of 4%. A mid-December report by the government's own intelligence service gave Raila Odinga an even larger lead of 8% to 15% over Mwai Kibaki. As the election drew near, the Steadman poll, which is conducted under the leadership of George Waititu, a close friend of Kibaki's, showed Kibaki catching up to Odinga although the total for the three leading candidates added up to 101%.

2) The Kenyan National Commission on Human Rights (KNCHR) reported that Muslim voters, most of whom were expected to favor Raila Odinga, were denied voter cards in the leadup to the election.

3) Prior to the election, Raila Odinga warned that Mwai Kibaki and his party planned to illegally deploy Administrative Police (AP) as poll agents for the purpose of intimidating voters. While Mwai Kibaki originally denied these allegations, subsequent events showed that Odinga was correct--the East African Standard reported that 65,000 APs were in fact illegally deployed to various parts of the country.

4) Prior to the election, the impartiality and credibility of the Electoral Commission of Kenya (ECK) was jeopardized by Mwai Kibaki's control over the appointment of foreign observers. The East African Standard reported that ECK Chairman Samuel Kivuitu had himself accused the Kibaki "government of selectively inviting international observers for the December polls." Member of Parliament William Ruto of ODM also voiced concern, stating that "Kibaki has gone against a precedence that even brought him to power. The President alone has appointed ECK commissioners. He alone has picked foreign observers. When you put these two issues in the wider picture of the run-up to elections, you see we have a reason to doubt the fairness of the coming polls."

5) Early in the election, when Raila Odinga went to cast his vote at a polling station in his constituency of Langata, he found that his name was missing from the poll register. Furthermore, names beginning in 'A,' 'E' and 'O'--traditionally Luo and Luhya names--were missing.

6) Raila Odinga's ODM party firmly secured the Parliament, winning more than 45% percent of parliamentary seats--that is, at least 95 out of 210 electable seats--compared to Mwai Kibaki's PNU party which secured only 37 seats in total and lost 22 of its original 32 seats. The ouster of the majority of Kibaki's cabinet was regarded by many as a bold statement to the degree to which the majority of the electorate had lost confidence in the Kibaki administration.

7) In Garsen, a mob destroyed 35 ballot boxes on suspicion of rigging.

8) One constituency, Maragwa, reported 115% voter turnout.

9) Although voting ended on Thursday, December 27, the announcement of results from some polling stations was delayed for more than two days because:
a) The aforementioned irregularities compelled numerous complaints from candidates of both parties.
b) ECK returning officers from disputed polling stations could not be located by Kivuitu and had turned off their cell phones.

10) Samuel Kivuitu, chairman of the Electoral Commission of Kenya (ECK), himself acknowledged that the delay would have allowed time for these missing officials or others to rig votes. "This is where cooking could be taking place," said Kivuitu.

11) The ECK failed to address the majority of these concerns raised by Raila Odinga, his ODM party, and the general public and proceeded to announce the obviously illegitimate results, thereby failing in its responsibility to the people of Kenya and lending validity to the debacle.

12) After the ECK announced the results, declaring Mwai Kibaki the winner, the East African Standard reported that an ECK officer alleged that there had been "blatant and shameless alteration of documents" primarily by "information technology officials." This officer said that the Coast and upper Eastern provinces were most affected by rigging, but also named the constituencies of Moyale, Laisamis, Saku and Matuga.

13) A Reuters article also quoted an "election observer who asked not to be named" as having "very little doubt" that the election was rigged.

14) Furthermore, before Kivuitu declared Mwai Kibaki the winner, Alexander Graf Lambsdorff, chief European Union election monitor, stated that there was ``a big question mark over the tallying of results.''

15) After Kivuitu declared Mwai Kibaki the winner, Lambsdorff repeated his misgivings. "We regret that it has not been possible to address irregularities about which both the EU and the ECK have evidence ... some doubt remains as to the accuracy of the result of the presidential election as announced today," said Lambsdorff.

16) Lambsdorff has again gone on record as saying that the tallying process lacked credibility.

17) Prior to Mwai Kibaki's secretive swearing in ceremony, the Kenyan government suspended all live television broadcasts. Coverage of post-election violence, including the government's use of armed police in suppressing demonstrators, has therefore been difficult to verify. In view of the above irregularities, this has had the effect of further eroding any semblance of democracy.

18) Finally, tallies reported by the ECK differed from those announced at polling stations and on television news broadcasts. The New York Times reports that, "The European Union said its observers in one constituency last week witnessed election officials announce that President Kibaki had won 50,145 votes, but on Sunday the election commission increased those same results to 75,261 votes."

Taken as a whole, this evidence is more than enough to declare the presidency of Mwai Kibaki illegitimate and to install the legitimate winner, Raila Odinga, into that office.

5,000 people were killed on Sept 11, 2001 in America and the world "is at war".

21,000 people were murdered in South Africa last year, and rest of the world turns a blind eye!

An 8 month-old baby girl was raped to death by 5 men in Cape Town, South Africa, as they thought it would "cure their Aids".

A 24 year-old pregnant woman was repeatedly raped in her home in Birch Acres, Kempton Park, South Africa on Monday, January 08, 01.

A five-month pregnant woman, her husband and their five-year-old daughter were relaxing at home when four unknown men entered the house. The husband (32) was tied up and held at gunpoint while the suspects raped his wife in the dining room. The suspects then ransacked the house and took electrical appliances, household goods and clothing valued at about R20000.

No arrests have been made. The gruesome list goes on and on . . .
For once, this is a worthwhile message to pass on - for my friend Jeremy Sutton who was murdered, leaving his 8-month pregnant wife, Trish, behind - and for all others who have been touched by crime.

If Gary Teichmann can sign this so can all of us. One Sunday Times front page headlines stated:

Toddler sodomised to death. 2-year-old girl sodomised so brutally, her wounds shocked doctors. Her anus and rectum were so severely injured that medical staff could literally see 3cm inside her body. The rapist walks free after police corrupted her file.

Dear Friends Chris Duncan here. I know a lot of you have received petitions like this before and many more like it.
I also know that there is a serious problem in South Africa. I know a lot of you don't feel that there is much of a problem and refuse to be part of petitions to stop murder. I ask you now, please: If you refuse to do a simple thing like placing a name to a list in an attempt to bring it to the attention of your leaders, what are you doing that the rest of us don't know about to stop it?

Even if it's to clear your conscience so that in a small way you can say you did something, it is worth it.
What would it take for you to suddenly spring into action?

Should your child, wife or husband need to be killed first?
Please think about it and think perhaps it can help instead of "what good will it do?"

Following the latest child killings in Cape Town, I hope Cape Tonians and South Africans in general are prepared to take a stand to stop all this crime. For our son Peter Marks who was brutally beaten to death leaving a young wife and son of eight months and devastated family behind and for all others who have been touched by crime.
