3. Have Mercy for Don Gilson

Clemency Themes: We are presenting 3 major grounds for Mercy/ Clemency.

First, due to the unique circumstances, Don faces an execution even though it is unclear what conduct he is being executed for. Even his jurors say they did not know who inflicted the abuse causing Shane’s death. This was expressed both in their split verdict and recent Affidavits submitted.

Second, it is unfair Ms. Coffman received a life sentence while Don is executed, when the overwhelming evidence points to Ms. Coffman as the “committer” and Don the “permitter.” This result is distressing to certain jurors, who denounce their death verdict in light of Ms. Coffman’s sentence. Two jurors say they’d be “relieved” if Don’s death sentence was commuted to life. Id.

Third, Don’s involvement in the offense is likely attributable in great part to his profound brain damage suffered from a near fatal 1993 auto accident. The accident resulted in loss of 25% to 33% of the functioning of his brain. A mentally impaired Mr. Gilson walked into a deeply dysfunctional situation which he was simply not equipped to handle. The mitigating evidence of his permanent brain impairment was never presented to his sentencing jury.

4. Holy Trinity Gives Second Chances

On December 20, 2006 a student at Holy Trinity Catholic Secondary School, who we will refer to as simply Matt, was caught in the act of trafficking.

Although we realise this is highly illegal and any persons caught involved in this kind of behaviour should be given strict consequences, we are asking the Halton Catholic District School Board, and Holy Trinity Catholic Secondary School to show mercy to Matt in this situation.

We aren't asking Matt to be exempt from any legal action. We are asking for Matt to be allowed to continue to attend school at Holy Trinity, if not this year then next year when he has served his probation or any charges that have been laid. As a catholic community we believe in second chances, Jesus showed mercy to those who have sinned, we are asking that the administration do the same.

5. No Man Should Die Without a State

Robert Jovicic is a man without state.
Born of Serbian parents, he arrived in Australia from France when he was two years old. He has lived 36 of his 38 years in Australia.

In 2004,Immigration Minister Philip Ruddock deported him on character grounds after he was jailed for several burglaries to support a heroin addiction.

Desperate to return to his home country, he camps outside the Australian embassy every night.His health is not good, and his family believe he will die if not returned home before the onset of European winter.

He speaks no Serbian & only speaks English,with,as you'd expect,an Australian accent.He wants to come home to his family in Melbourne.
The Serbian gov't do not recognise him as a citizen,& as a result he cannot work, receive welfare or medical services & is virtually destitute
Effectively,he has been dumped there,in a country that is an absolute stranger to him.

If he lacks Australian citizenship,he is an Australian in all the ways that matter-his family is there & he knows no other home.

While in many cases it is reasonable for a nation to exclude criminals from residency in order to uphold the rule of law & national security,I believe this is a case that warrants mercy. Addiction is a terrible illness This man is too unwell to be a threat. Without access to housing or medical care his situation is dire.No man should be left to die without a state.

Australians have long prided themselves on being a land that gives people "a fair go". I urge the Prime Minister to show that justice can be tempered with mercy,and give this ill man a 'fair go'at staying alive,by simply being allowed to COME HOME.
