I look at it this way, although ebay shutting its metaphysical community down may not bother you. Maybe you are on keen, or bitwine, oranum.... ++++ Maybe you go other places. This is fine. To whom it may concern
I am writing to eBay to express my dismay over your recent decision to remove certain categories under the metaphysical heading. While I understand some few sub-par sellers may have caused charge back issues, this is certainly not the norm among sellers in the Metaphysical categories. Most have exemplary feedback and many happy and satisfied repeat customers. In fact, the feedback of metaphysical sellers as a whole is probably far better than sellers of electronics and other like merchandise.

There has also been the statement made that many sellers are dealing in 'intangible' items. While we understand this poses an issue with eBay/Paypal dealing with refunds and charge backs when nothing is mailed, selling an intangible item has long been against eBay policy anyway. Many sellers know this and DO mail items to their customers. Those that do not should be educated in eBay rules to cease this practice which has long been against policy.

What is alarming now is that the blanket term of 'intangilbe item' is being used to ban actual ITEMS. Jewelry, crystals, stones and other items with ADDED energy work or yes, what is commonly called 'spells', are being targeted. What concerns me is your purposed selective enforcement of what you(eBay) terms 'intangible'. It seems you only have targeted those sellers who offer items of a certain occult or esoteric nature, ie. pagan beliefs and witchcraft. Magic, Spells, items of a paranormal or psychic nature, etc....

Sellers have also been told (via EBay's Facebook) that the prices of their tangible items can not reflect any significantly added value put on by any intangible addition. What a nightmare for eBay to enforce since many items listed every day are priced subjectively by the sellers in many categories such as art, antiques, jewelry, vintage items and collectibles. The market determines the price and people will pay the price or they won't. Again this seems like only sellers of certain occult natured items are being singled out for selective enforcement if the Facebook statement is true.

EBay has not disallowed Feng Shui items or 'New Age' items like Crystals used in healing and crystal work, both of which have 'intangible' properties that are believed in by MANY millions and millions around the world and add to their value in the eyes of many. You have not banned rosaries, crucifixes or religious medals, all of which have perceived 'intangible' abilities and energies associated with them. You have not banned items like Aromatherapy products which people use to gain certain 'intangible' benefits from. Magnetic therapy jewelry. Radionic devices and the entire category of natural and homeopathic remedies are items that people must subjectively get 'intangible' and unverifiable benefits from. The list of items with 'intangible' benefits goes on and on. I ask HOW are these any different than spells, blessings, magic and energy work placed upon items? How do these items differ in dealing with any Resolution Center disputes?

I am saddened and deeply concerned that eBay's new policy may appear to some as a form of religious or ideological discrimination against occult and esoteric metaphysical beliefs. Something that I'm sure eBay does not want to imply.

Various Pagan, Neo-pagan, Alternative and Wiccan beliefs are ages old and actually a rapidly growing segment of our world population. Not everyone subscribes to the 'Big Three' religions, four if you include Buddhism.

In fact according to religioustolerance.org:

"A second important statistic is the rate of growth of the Wiccan community. "In May, 1998, the Chicago Tribune reported that, though difficult to quantify due to lack of formal organization, neo-paganism is the fastest-growing religion in North America with the Internet being the prime means of proselytizing." 1 Ms. Curott estimates a doubling in size every 18 months. This growth rate seems quite high, but appears to have some credibility in the Wiccan community. The ARIS survey of the American adult population indicates a growth in the Wiccan community of 17 fold between 1990 and 2001 - the highest of any faith group monitored. This would indicate a doubling in numbers of adherents about ever 30 months. 2 Maria Alupoaicei, who co-authored the book "Generation Hex" claims that "The numbers of [Wiccan] adherents are doubling every 30 months." We suspect that she derived her estimate from this essay. She notes that there are over 700,000 websites for Wiccans on the Internet.

If the latter growth rate is accurate and if it continues, then Wicca would be the third largest religious group in the U.S. by about 2012, behind Christianity and Judaism, and ahead of Islam."

If this is all a misunderstanding, I apologize but there have been many mixed messages coming from eBay Customer Service reps who tell sellers who call in that not only are readings of all types and direct cast spells(non mailed item) being prohibited, but that ANY item, TANGIBLE ITEM, that mentions a spell or magic anywhere in the title or listing is now prohibited. Sellers are told that the use of certain WORDS are banned and listings will be scanned for these certain keywords like magic, prayer, blessing, psychic, spell, haunted, etc... I can only imagine what a nightmare this will become if that is true, with listings being pulled just for using a certain keyword picked up by a computer bot.

I ask that eBay consider carefully how targeting certain beliefs and practices may look to the world as a whole-a world where millions of people hold alternative and differing cultural beliefs. I think sometimes certain corporate departments can be short sighted in making changes whose widespread ramifications are not well thought out.

I am only ONE of HUNDREDS if not THOUSANDS of persons, both buyers and sellers of items in the Metaphysical Categories that are asking these same questions now.

People CLAIMING to cast spells or otherwise do magickal work for customers on eBay do NOT help the cause of the Pagan community! We already have enough propaganda and ignorance working against us, why would ANYONE be upset that eBay is cutting Fraud out of the picture. It's NOT a negative thing, it's a good thing as it stops innocent people from being ripped off in the name of witchcraft. It's NOT discrimination as it also applies to Prayer and other similar Non-Pagan services of this kind. If they were specifically banning PAGAN items or sales, it would be discrimination, but the fact is, they aren't! Tangible items are still for sale, and are NOT being banned! 4. Increase the feedback time on eBay on Flowers, Trees & Plants

This petition is for the help against unfair sales on eBay’s category - Flowers, Trees & Plants.

Their policy on feedback is: Must be left within 60 days of the auction's close or the ability to leave feedback is lost.

This policy needs to be changed on their category: Flowers, Trees & Plants, since it is not enough time to see what the plants or seeds grow into. Under this policy people “including myself” have gotten wrong or fake seeds / plants that a seller says it is.

Some of these sellers are selling fake seeds / plants because they know the buyer has only 60 days to leave feedback and about time they find out what type of plant he/she has gotten its already too late.

As the policy stands it hurts the honest sellers, and helps the bad sellers.

5. PROTECT THE VICTIMS OF CHILD SEXUAL ABUSE IN SRI LANKA

At the request made by the mother of a child sexual victim, the Judge at the High Court in Sri Lanka (Case No 39/2004), made a recommendation to the Attorney General to withdraw the indictment.

After considering all the facts involved and in view of the sheer severity of the damage that could cause to the victim in this particular case, the AG agreed to withdraw the charges. Unfortunately the news papers published the details of the case including false information violating the child's right to privacy and confidentiality, totally destroying the intentions of the courts and causing immense damage to the victim and her family.

This secondary victimization has severely damaged the victim without giving her the opportunity to rebuild her life.

6. Stop the sale of tattoo equipment via online auction sites!

I am a professional tattooist, calling for a ban on sales of all tattoo equipment via online auction sites. I am also calling for the sale of tattoo equipment to be limited to professionals only.

Since sites like eBay sellers started selling cheap tattooing kits, back yard tattooing has flourished, bringing a rise in substandard tattoos, scarring of individuals and the higher potential to spread diseases such as Hepatitis C, HIV, and other blood borne diseases and infections.

There is no limit to the age of the individual buying such equipment, and therefore teenagers are getting hold of this equipment and tattooing themselves and their friends, with no idea how to properly prepare skin for a tattoo nor how to actually operate the machines correctly in order to apply the tattoo.

8. Say NO to eBay manipulation of search results!

eBay recently implemented changes to how search results are presented to buyers. They advertised the changes as "Sales over impressions" - meaning listings which sell more per viewing will be shown at the top of listings. Also the seller's feedback history was to play a part.

However - the largest change that actually occurred was that the single most important factor in determining which listings are shown at the top is whether they offer free postage. Perform any search, and you will be shown all fixed price search results with free postage before every any fixed price listings with a specified postage cost. It does not matter whether the items with specified postage costs are actually lower overall, whether they have sold hundreds of items, or whether their seller has better feedback - ALL listings witha postage cost are now shown below ALL free postage listings.

Why is this a concern? Free postage listings RAISE THE COST OF THE ITEM FOR BUYERS. Ebay does not charge final value fee percentage on specified postage costs. Free postage listings just mean adding th postage cost to the item price. but By including the postage costs in the item price, ebay benefits by then having a higher value item price to that their up to 7.9% fees out of . These higher fees are then passed on to the buyer as higher item prices.

Not only this - by including postage cost in the item price buyers are not able to benefit from combined postage costs for multiple items. Sellers will also be very restricted in the circumstances they may offer returns and refunds because refund or credit of item price means they will be out of pocket for postage costs. Furthermore - when postage costs vary according to buyer location, buyers whose postage would have been cheaper with a specified postage cost tailored to their location will end up paying a higher rate when the postage rate is changed to a flat rate for all buyers and added to the item price.

By showing only free postage listings first, items with specified postage costs that were previously at the top of search result through a natural rise caused by item popularity and seller good feedback history have now been dropped out of buyers view. For some items, buyers must scroll through dozens of "Free postage" listing before ever seeing the items that used to be the most popular sellers according to buyers own preferences. This occurs even though generally the items with the specified postage cost are lower in overall price included postage than the free postage items listed above them! The sellers of these item therefore will be forced to raise item prices in order to offer "free postage" just so that buyers will actually get a chance to see their items and therefor purchase them. It does not matter how many buyers purchase these popular items anymore - ebay will never list them above a free postage fixed price listing!

So why would ebay promote the free postage listings at the top of search results if it disadvantages buyers and sellers?! Simply because they make more money out of the higher final value fees! Ebay's response so far has been to try to deny they are doing this intentionally and blame it on "the system changes" - as though they were not the ones who designed the system to operate this way! They claim that postage price does pay a small part in listing results - but any search will clearly show that regardless of all other factors, free postage fixed price listings are shown above all non-free postage listings. This makes it the PRIMARY factor, and thus ebay is presenting their search system in a completely dishonest way to its buyers. Not until hard pressed to show a buyer a specified postage listing that appears above a free psotage listing will they actually admit to these apalling changes. In other words - ebay are pretending to be promoting cheaper items - but in reality they are attempting to manipulate buyers into only seeing and hence only buying the items for which ebay will make more money.

In the old system from ranking search results - if the free postage listings were actually cheaper, they would have been the most popular in sales and views - and hence would have risen to the top of results automatically due to popularity and high sales! Reality is buyers were not purchasing those items because they were not good value - so ebay has now begun manipulating the search results in order to cause the buyers to purchase these items anyway!

NOT FAIR!!!

Ebay were recently prohibited by consumer affairs organizations in the UK from forcing sellers to offer free postage on all items - manipulating search results to show only free postage results first is ebay Australia's way around this!

Its time to stand up and not let ebay disadvantage sellers with good items and best prices by hiding their listings where nobody can see them - just because ebay don't make as much money from them!

It's time to stand up and not let ebay try to tell us what to buy - just because they will get more money from it!

Stand up for an honest search standing system, based on what buyers actually want and actually buy - not what ebay gets more money from!

9. Make eBay Fundraising Easier

eBay Australia, has made it way too hard for most people to use it as a fundraising platform. Getting authorisations and setting this up takes a lot of time, so most people can't be bothered. Also most people don't even know you can fundraise through eBay.

So, they need to make this much easier, and promote the fact that it can be done. Being the huge community it is, gives it huge potential to do things great. At the moment very little is done. If eBay wanted to utilise all of its potential then it would make Charity Fundraising easier.

All they would need to do is:
-Get authorisation from list of organisations themselves, cutting out the hassle for sellers to have to do this.
-Set up the option to have a percentage of your sale donated to your selected charity, in the listing designer.
-Set up a system where this percentage is sent to themselves (eBay), and eBay sends it to the selected charity.

This needs to be done... and now!

10. Unfair eBay and PayPal Policies

Many people who use eBay, regularly or not, are probably aware of the restrictions set forth by eBay and PayPal's "Buyer Protection" scheme. Unfortunately what most people are not aware of, are the hideous policies that undermine the entire premise of "Buyer Protection".

eBay and PayPal both make buyers and sellers aware that Australians are legally entitled to a refund when an item is bought at a buy-it-now, or, store price. This means any items which you pay a set price for fall under Australian laws regarding refunds. However, eBay virtually enforces PayPal as a payment method which attempts to make purchasers feel safe. But, PayPal walks all over the law with the following two restrictions:-

1. PayPal will only allow you to dispute a transaction ONCE. This means that should you for any reason start a dispute for an item, be it not received, or not matching the item description etc, and you accept a partial refund for minor discrepancies, that is it. PayPal WILL NOT re-open the dispute should you wish to claim for the items warranty and the seller refuses. You are also NOT ALLOWED to start a second dispute for the item. This means that any and all warranty terms are thrown out the window.

2. Should you have a problem with an item AFTER PayPal's 45 day window of opportunity, the decision to refund falls entirely on the shoulders of the seller. Which means, even though they are required by law to give you a refund for an item, and should they refuse to respond to contact, refuse to issue the refund etc, PayPal WILL NOT assist you in obtaining the refund, even though they are the financial institution, or, "middle man" who handle anything from giving/receiving monies for the transaction to international exchange rates.

Contacting the police (as suggested by eBay and PayPal) WILL NOT help you in these matters, even if the items are counterfeit and you have an admission of that fact from the seller in writing, unless the value of the item you bought is worth $8,000AUD or more.

Stop Scalpers - Take Action

Make it illegal for tickets & merchandise to be sold for more than face value.

For years I've found myself frustrated by scalpers. Their objective is simple, to buy event tickets & merchandise in mass & re-sell them to the public & make a huge profit. Tickets are most commonly re-sold via online sites such as eBay. It's a get rich quick scheme. A scheme which affects all of us, the fans. Whether it be music or sporting events, the fans end up losing out & not getting tickets to the events. If they do end up getting tickets, is because they've generally been forced to pay anywhere from double to 10x more than the official retail price.

I've had enough. It's time to fight back. With your help, we can take this to the top & change the law. My plan is to get as many people as possible to join this site & let their opinions known. Once a significant number of people have joined I will start by taking this to local parliament in each state, to federal parliament, to a variety of media including newspaper, radio & television, to ticket issuers & to eBay.

Examples of current legislation:

The Victorian Minister for Sport and Recreation has declared some events as “declared events” under the Sports Event Ticketing (Fair Access) Act 2002 (Vic). Examples of declared events include the Australian Football League Grand Final and the 2007 World Swimming Championships. This legislation deems the conditions on tickets to such events as valid and enforceable. Those conditions include the requirement that these tickets must not be re-sold above their face value. Tickets for declared events must be listed at the face value of the tickets or below, using the “Buy it Now” function.

Queensland legislation makes it unlawful for a seller to sell or offer for sale tickets to some events held in Queensland at a price greater than 10% above the original ticket price for the ticket. If you are selling a ticket to a national or international sport, recreational or entertainment event, or special event that is staged at a facility that the Queensland Government has declared to be a major sports facility, you must not, within or outside Queensland, resell (this includes offer for sale) the ticket at a price greater than 10% above the original price of the ticket. 16. Consumers Against Ticket Scamming

On several dates in March, many people logged on to the Ticketmaster website to purchase tickets for the 2009 Jonas Brothers World Tour presale. Withinthe first 5 minutes, the presale was almost completely sold out, leaving less that desirable seats scattered throughout the venues. Shortly after, many tickets, specifically VIP and floor seats began to appear on eBay.com for ridiculously escalated prices.

Assuming there would be seats left during the General Admission sale on the morning March 28, many fans signed on. Instead of a renewed chance at purchasing decent seats, they were only met with disappointment, and an even worse selection of seats than offered during the presale.

Having dealt with this during the Jonas Brothers' 2008 tour, I decided that perhaps my only option would be to purchase from one of these resellers. Upon contacting one in particular and making an offer of $400 for four floor seats (which are priced at approximately $80 each), I was informed that any offer not close to his requested $900 would be declined.

Tickets are already costly, and fans should not be forced to pay anything more than face value in order to enjoy their sought experience.

19. Petition against changes to the Ebay feedback system

As you may be aware, Ebay will soon be introducing changes to their feedback system to prevent sellers from leaving negative or neutral feedback for buyers.

This change fundamentally undermines the whole function of the feedback system, as there will no longer be any way for sellers to identify problematic, unreasonable or fraudulent buyers.

In fact, as a result of changes already made, there are now 6 avenues for a buyer to give a bad rating to a seller (via feedback, and via the five "Detailed Star Rating" categories) and only one avenue for leaving a poor rating for a buyer - and now eBay want to remove even that!

Additionally, leaving negative feedback for a fraudulent buyers is a service to the entire eBay community since it makes them immediately identifiable to other sellers, who can then block them allowing genuine customers to bid and win items more easily. This will also reduce the amount of time eBay has to spend dealing with further seller complaints.

Finally, if there is only one kind of feedback that can be given to buyers, then there is no real point in sellers leaving feedback at all - it just becomes an exercise in pointlessness and a waste of time. Despite widespread criticism, eBay have failed to take into account the genuine concerns of their own customers - that is us, the sellers.

This leaves no option but to take action - if eBay will not provide a feedback system worth using, then why should we use it at all? Let's see how well eBay will work if sellers don't leave feedback at all!

20. Stop Ticket Scalping on eBay Australia

On November 12 2007, many people logged on to the Ticketek and Ticketmaster websites to purchase tickets for the Bon Jovi presale. Within 1 minute, the presale was sold out. 30mins later, many tickets began to appear on eBay Australia for up to 5 times the original purchase price.

These tickets have an original purchase price of $199. So the total face value of these tickets is $400.

On November 15 2007, tickets to the same concert went on sale to the General Public. Again, tickets sold in minutes and again, eBay was flooded with auctions only minutes later.

To address this issue, I started an auction on November 12 2007 for a mouse, in which I also told my story about how the mouse was unlucky and I proceeded to explain how scalpers had stolen our tickets. The auction was taken down by eBay 15hrs later as it was in the wrong category. In these 15hrs, I have over 300 views and over 35 emails of support to "Stop the Scalpers and enforce ticket sales on eBay to be at Face Value ONLY".

I relisted my unlucky mouse, along with my story on November 13 2007 (in the correct category). eBay shut down this auction on November 15 at 4:00pm. The reason this time was that I was expressing personal views in my auction (as I mentioned that I dislike the scalper scum on eBay). In the 2.5days the auction was up, it had over 1400 views and over 130 emails of support.

eBay will let scalpers sell tickets illegally, but I cant voice my opinion? So here I am!

21. Ban ebay ticket sales

Most people that are regulars on the gig scene and even ones that are not will know, trying to get tickets to see a band / concert these days is mostly down to luck.

This I believe is due to the amount of people buying tickets simply to sell them at huges profits on ebay. The evidence to support this claim can be seen by anyone that goes onto ebay and searches for tickets. I recently seen a £12.50 ticket for one of my favourite bands on ebay selling for £90 (this was the day after i tried myself to get tickets to this gig with no luck).

It is my own opinion, as well as most of the people i have discussed this with, that if ticket sales on ebay are stopped there will be a lot less people buying them simply to sell on, and a lot more chance of genuine giggers being able to purchase them at their true value. 23. ebaeseller : free removal of negative feedback

I think it is wrong to expect victims of Scott Marlatt's ( ebaeseller -the way his company is spelled )( ORD OF THE SWORD, now advertized by Medievalists.net )slanderous, retaliatory feedback to have to pay to remove it!

It gets to point after a certain number of victims that it is obviously the sellers problem & not the buyers. E-Bay should recognise this and remove all negative feedback that this seller (and others like them) leave that is challenged by the buyers, especially when they make their feedback private, or are no longer registered users (or both, as in this case).

If buyers have already had money stolen by ebaeseller ( Scott Marlatt ) they should not have to pay more to get sellers lies removed from buyers record! They also do business as empire pets & empire swords.

I feel it is also up to companies such as Ticketmaster to do more to stop re-sale of tickets. This is starting to become a major issue (it was covered this week in New Musical Express)and I think this could be a way of making ebay and the promoters consider the ramifications of easy re-sale.
